Has anyone filed LC with a small employer? Should there be a concern with an employer who has an employer identification number, but is filing his tax returns as an individual doing business as. Has anyone gone this route? Please help.

The attorney is saying that this could be a problem with I140, where they ask about ability to pay. And my employer can only show himself as an individual doing business as. Of course, he can show the filed with the IRS schedule C, which is directly related to the company. Is that going to be enough?

Your attorney is correct, your LC will get approved with no problem. I 140 stage it is very difficult to prove financials.

You will be fine if your employer is making way more than your PWD and if he/she can prove that to the USCIS at I-140 stage (through bank statements, tax returns, financial statements and other such documents).
