Employer in NJ, Working in TX, Need New LCA?

Hi,

My wife's employer is located in NJ and She works in TX. Should an LCA be filed for TX or is NJ LCA sufficient? Because I think LCA is dependent on state where you work. I was of opinion that the LCA should be filed.

Her employer says that to file an LCA there have to be a companies branch in TX is that true? Is that required? I have never come across this comment.

Please advice on this and any links for more info if available.

Thanks Ginnu,

The employer is under impression that he has to register the company in TX pay employment tax here in TX. Is it the employers responsibility or the employee's responsibiity to take care of it?

Any links I can read up?
