Employer didn't repond to 45 day letter.

My company's HR department screwed up big time and didn't respond to the 45 day letter in time. Now the BEC (Philly) says they didn't receive the letter and they are closing the case. Lawyer says he will try and remedy the situation, but I don't know what can be done.

Is it too late to do anything? Anybody with similar experience?

My case is not exactly similar. But I thought I will share it with u. My lawyers claim that 45 day letter was never recd. PBEC says tht it was sent out in Jan itself and when there was no reply fm us, they closed the case in Apr. My employers/lawyers did receive the case closure letter in May. But they didn't do anything about it. Nor did they inform me.

I finally found out in July on my own that my case was closed by calling the #202. Bugged my employer/lawyer a lot and made them reopen the case immediately by sending email to reopenrequest email id. My case was reopened last friday. I have the screenshot confirming the same.

Is ur case already closed?? If so, just ask ur attorney to send a email to the reopenrequest mail id and it gets reinstated within a couple of days. Hope this helps.......
