Hi,
My H1 stamp in passport expires in 2007 but I dont work for that company anymore and have a new employer and a new I797. I am planning to make a short trip to India.
1 ) Do I need to get new H1 stamp in passport with my new employer or the old one will work fine as it isnt expired yet ?
2) At port of entry should I be producing my new I797 and be ready for questions like why i didnt get new stamping done ?
3) My wife is planning to return back after I do, does she need to produce my original I797 as even her H4 in passport has my old employers name in the stamp. Her H4 also expires in 2007 with my H1 expiry.

Thanks,
kk

--------------- no need to get NEW Visa stamp ,at POE show your passport with valid h1 visa stamp and new H1 approval notice and you will get I-94 till your H1 approval notice check the I-94 date at POE if any mistake point out or ask for the supervisor
2) At port of entry should I be producing my new I797 and be ready for questions like why i didnt get new stamping done ?
----------Passport visa stamp AND new H1 approval notice is enough, new stamp is not needed
3) My wife is planning to return back after I do, does she need to produce my original I797 as even her H4 in passport has my old employers name in the stamp. Her H4 also expires in 2007 with my H1 expiry.
------------------ she has two options:
A: she CAN enter with H4 valid visa stamp that is valid till 2007 and she will get I-94 till 2007 employer name on H4 stamp is not a problem
B: she can show H4 visa stamp and YOUR H1 approval notice at POE and she will get I-94 till your H1 approval notice
Thanks,
kk
