Employer asking money for H1 Visa extension

Hi all,

I am in USA for 5 and half years and my Visa is expiring in Jan 2006. My employer is asking me $2500 for my H1 Visa extension, which I can't afford to pay, becuase he gives very low salary and I pay him $800 monthly for Medical Insurance. My employer paid the VISA fees 2 years back, but now he says he can't pay that amount.

What is the last date before VISA expiration to apply for VISA extension?

Is there any way to complain about my employer to DOL or INS or both?

Please let me know the best way so that my employer pays that amount for my Visa extension.

You should find another job years ago. Just find another job :)
I don't know why you need to stick with someone pay you very low salary and ask you to pay for your insurance. I am very supprised to see you can not afford just 2.5K after 5 and haft years working here. Most people who work 5 and haft years here should have at least a few 100K on their pocket.

Let me count for most of my friends who come here after 5-6 years.
1) Let imagine average income 100K/year. Minus living cost, you at least save up to 30K/year. 5 years = 150K saving. I did not count bonus, stocks ...

2) Some do not save and buy a 300-400K house after 1-2 years saving for down payment. Now they got at least 200K after 3 years bubble housing price plus they downpayment and principle pay. So they got around 300-400K now, plus some extra from stock, bonus and so on...

With 2 ways like that people could have save from 150K to 400K in 5 years. Some got more than that.

All of them come to this country with the rule that not to accept any junk jobs. Only work on what they pay right and fair. This is a fair country and you work hard you must deserve better. If not, hey we go back to where we come from.
 
1) If you're making 100K/year, you are making about $5,600 a month, in order to save 30K/year, you need to save 2,500 of it every month, that leaves you with $3,100. If you rent and not buy a house, here goes $1,000 (unless you leave deep in the suburbs), 2,100 left... You finance a car (which most of us do), a new toyota corolla (basic basic model) is about $384 if you have the best credit. Plus insurance for this car is another $100 or so if you're over 25. Let's say with gas and all, $500. You now have $1,600 in your pocket. IF you have any type of a social life, take out another $500 a month for expenses like going out, doing some small shopping, etc... $1,100. IF you are married, and your wife cannot work, you are screwed.

1-b) Average base salary for a technical job hovers around 60K. This price is good for Americans as well as foreigners. That doesn't mean that our jobs are "junk" like you say. It just means that we need to start from somewhere.

2) In 3 years into the house, if you can pay off 200K of the house, then you have to be richie rich.

3) Bonus of a 100K salary would be 15,000 max. Half of it goes to taxes, 7,500. 3 years, 22,500. It's not huge savings there either.

Respect people who didn't get the chances you got. Some of the folks here would have gotten only few bucks a day in their home countries if they didnt come here. They work just as hard as you, and they deserve a little more respect.
 
Having few 100K is a good thing to have when you are at one place from past 5 years and with high salary like $80K. I have been moving east-west, west-east every 5-6 months, the apartments rent, leases. after all this, my stupid employer pays just 48K (even after 5 years of US stay) and promised that he does the GC. But I came to know that I need to bear all the GC expenses after Labor approval. I am getting frustated with all this.

I understand each person has his/her own goal. Some accept to trade off working for greencard (don't care about income), some think about income first and green card later. But please keep in mind that all employers do GC unless the company is laying off people.
If your employer did your labor 5 years ago, you should get your I-485 very soon (very few years from now). Then you are a freebie :)
When did he start your LC? EB2 or 3?

Not really. If you buy used cars for the first few years, you don't worry about that $500/month.
If you choose the right appartment to rent, you could rent 850/month appartment in bayarea. if you are single, why not sharing a room for 250-400/month.
If you don't spend that much $500/month for your social life ..., you can have much left right.
Having wife does not mean screwed :) how much another person eat a month? How much other expense? Think about how much it save you. No more going out for lunch/dinner because lazy cooking. Think about tax cut for couple. Think about spending more time with wife rather than going for some social life that cost money.

The salary I count is for SF bayarea. Of course other place is much lower and different.
Here is the average salary
Entry level (Software engineer or MTS1) 55K (BS+0)
Junor level (SW Eng 2 or MTS 2) 72K (MS + 0 or BS+2)
Senior level 1(SW Eng 3 or MTS3) 99K (MS/BS + 5)
Senior level 2(SW Eng 4/5 or MTS4) 120K (MS/BS + 10)

So, if we come here after around 5 working years from home, we could expect to get SW Eng 3.

I don't mean to payoff 200K, I mean the house could raise 200K or more.
A new 4 bedroom house in 2003 (2002 is much lower) = 350-400K
The same 4 bedroom house now is 650-750K.
You have a raise of few hundred K already.

22,500 is not huge but add on to what you have.

Yes, like I said different people have different goal. Some put GC as 1st priority, some put saving for future (so you can come back home later) as the 1st priority. Of course, all want GC.
We are working hard in this country. All of us do. But think about what you have after 5 years far away from home/family/friends. Think about your parents, they grown older and older. How many other 5 years they will have?
GC is a good goal, but either way you will one day go back home (unless you don't want to do that at all). What do you need? not GC, money . So, you should try for the job with fair income.

Its none of our business if he can't afford 2.5k after 5 years !!! :)

last day = less than 1 month after the visa expired. But you will not allow to work if not receiving a new receipt and your current visa expired. To be safe, submit around 1 month before the expiration (INS said they will issue receipt around 16 business days). So, start talking with your attoney around 1 and haft month before the expiration.

None. If you complain, he will not sponsor and you have no job.

It is hard to do that. By law, they have to pay for that fee. But that is just the law said. If you filed a complain, your H1B will be revoked and your employer may be called to question. There is no gain for you at all since you lose your status ...

I didn't even include the utilities and just the extra expenses the life throws at you ;)

By the way I chose toyota corolla basic since it's only about 12,000 dollars, many people would choose to buy a car for that amount even when it's used...

Also, all the jobless wives I'm around tend to spend a lot more than their working husbands because they go shopping for stuff for home, stuff like make-up, etc (not to categorize any women, I just have seen this stuff from women around me). I can't say much about the tax cuts, I do know that you get a lot more money if you are married and own a home, can't fight that one :D

I agree that his salary is low after 5 years, no doubt about it, but some people just try to take off their career after they get the GC. Who knows, maybe this isn't even the field that he really wants to be in... Different people, different plans...
