Emergiancy please help. Q regarding Birth Cert.

With the current visa number availability am trying to file for parallel 140/485.

I have the official birth certificate, but it only has my First Name and my fathers first name mentioned on it. It does not have either my Mothers name or our last name. :(

Will this cause trouble while filing 485. Would they reject the application on that bases....

I have been trying to get another full version copy from my birth country, but the authorities there are not co-operating... Accordingly this is the only form they can provide.. Please please.. guru's.. Please advice.

I didn't have my lastname & middle name in my birth certificate either... I guess that shouldn't be a problem. But if you want to be sure you could also provide an affidavit from your parents.

Ask for your attoney's opinion as well.

I believe they do not reject.

First apply, If they want all the name on birth certficate, they will send you RFE..

scrutiny depends on service center..

don't worry toomuch before applying.... just apply...
 
Suggestion

Instead of DOB cert you can file use affidavit from 3 people. (mum, dad and uncle or aunty). Submit this in 485 application.

Meanwhile try to get the certificate corrected. If RFE comes use it or you will be fine.

I got my GC approved 2 days back. I filed affidavit and unavailability of DOB certificate.

Hope this suggestion helps.

I am thinking since I have already mailed the documents along with the BC to the legal, I can also send them this affidavit to file along for 485.

Some questions about BC

Hi everyone,

I have a few questions too about Birth Cert.
1. I have got my birth certificate and everything looks fine except that i am concerned after talking to few friends that my Birth certificate doesn't mention the country anywhere. It is issued by a state authority and only mentiones the city and state on it. There is similar problem for my wife's BC also. So do you think an affidavit is necessary for this then?

2. My wife's BC had a typo in the address and we made two affidavits one from her father and one from aunt. In that we have mentioned complete address with country. So will that be enough for her? Also, the affidavit is made in India and sent here so will that be okay?

Dont delay and submit your application with what ever docs u have

Meanwhile, I have collected her birth certificate from Indian embassy and also two affidavits from her parents to furnish when we get the RFE. But you know what - no RFE, we got the approval last month. So, don't delay things waiting for any documents that you dont have, just apply and wait for RFE. Good luck to y'all.

Your lawyer should have template for affidavit. My lawyer gave me his own templates.

NKIMMI.....

Birth certificate with all the information is required..including parents/yours first and last name. But right now you can file what you have, later you can submit additional documentation once you get 485 receipt.
