UPDATE...Need further info!!!Emergency Travel after Interview

My wife and I had our interview last week where our case was approved (I am a USC). We have to leave the country next week on an emergency, and i cant get through to USCIS by phone to check on status. We were told that the GC will be mailed, but it may not arrive on time. They no longer stamp a temporary GC in the passport at the interview, therefore we are not sure what our options are to make sure she can enter the US upon our return. Should we apply for a re-entry permit? If so, how do we prove that we were approved at the interview?

Any help will be greatly appriciated. We are at a point where we will just leave and see what happens when we return, but the thought is anything but comforting.

Does she have a valid AP Or they took it during the interview?
 
Not sure what AP is, if it is the I94 she does not have it. She basically overstayed her visitors visa (i believe F1) and the I94 was taken when she tried to extend it.

AP is Advance Parole. But since she has overstayed, she won't qualified for that. You may want to visit your Local DO and ask them.
 
AP is Advance Parole

Advance Parole is permission to re-enter the U.S. after traveling abroad in order to continue processing an Adjustment of Status application.

Did you have a letter of approval from the interview?

I will not take the risk to travel and then come back and guess what is going to happen (which I can guess!). Remember that the officers at the port-entry will ask for documents and which documents she will have?

No letter from the interview... Thats why I am not sure how to reqeust a re-entry permit....

Doesnt sound like she would qualify for AP, since we already had the iterview and it was approved. Its just a matter of time before she gets the GC. I had a friend who received their GC two weeks after the interview, but it doesnt mean we will.
 
This is what I would do.

Laz,
Your best bet is to go to your local office and have them stamp your wife passport (I-551). Once you'll tell them that you have to travel and you are not sure when your GC will come in mail. I know that they are not stamping normally these days but given the situation they can do it. They can look up the approved status in their system. What do you gotta lose?
 
That sounds good. I will certaily try it as there aren't many options.

Well....no luck. It turns out the case is pending therefore no stamp was given.

We can apply for AP, but i am not sure how safe it is since she overstayed her visitors visa by a couple of years.

Any advice? The only reason she wants to travel is due to her fathers illness...

Sorry to hear that,
If she overstay several years she won't be able to get AP.
But I don't understand why they told you that is pending if you got approve on the interview :confused: ...probably is the time when they update the system.
I think you will have to wait until you get your GC on the mail. Did the officer explain why they didn't put the stamp on the passport?
