Emergency Deportation Problem

After almost 40 mins on the phone with my friend, he told me his asylum case was denied and he appealed the case and when he first went to meet the IJ, he told him he was not ready to present his case so they rescheduled the case but my friend did not show up afterward.. Now i called 800 898 7180 to check on case status and the IJ already ordered for his deportation on APRIL 17TH 1998..

I am little bit confused here-- how come was he able to come into the country without any problemS. My questions are as follow

1)Since they ordered for his deportation--does he need to appeal the case and then the IJ to close the case
2)Does he write a letter to INS to close his case


Any words of advise will help me out here.
 
Your friend is pretty dumb to rely on information found on a chat room to solve a problem of this magnitude. He needs legal advice.
 
He is still africa right now .. he did not know of this problem until he tried to renew his visa.. I could have sworn that if you dont show up for interviews and hearings when it comes to asylum, they just close the case..


I thought maybe someone had a similar case so i wanted to advise my friend but i know for sure if he enters the country he has to get a lawyer to resolve the issue..
 
There is something wrong here..

You don't get referral to immigration judge, when you apply for asylum, except if you ARE out of status, i.e. your visa status is expired, and the judge will determine if u will be eligible for asylum, otherwise, order for him to be deported, based on the illegal status. But, if you were IN status, whatever B1, H1, F1; simply the officer will deny your applictation for asylum, and will not refer you to immigration judge.
so, based on your story, your friend was out of status, but the question is: How was he able to get another visa to USA, despite being out of status before?? the law says 3-10 years ban from entering USA.

There is a loophole in the INS SYSTEM..


My friend is still not banned from entering the USA because he came here in 2005 but he said the official denied him a visitors visa instead they gave him a business visa instead.

The way I see it: if your friend has a final deportation order against him = it is a closed case.
 
Opinion,

When my friend arrives we will consult an experienced lawyer to solve the problem.. I told him already it looks like a closed case that cant be reopened anymore.
