Emergency Asylum Case Problem

Guys,

I need your help on this matter.. In 1996, my friend filed for asylum but in 2000, when he was called for an interview he did no show so nothing happen until 2003 he finally when back to africa. In late 2005, he came back to the USA with a visitors visa with no problem but just last month he went to the renew his visa but he was denied because they said he filed for asylum before and he explained to them that he dumped the case but the official in the embassy said no that the case still open. Now just yesteday, he went back to the embassy to get a business visa and they gave it to him but they said the same thing to him that he has to finalize his asylum case.. I asked him did he ever get a letter from INS about not showing up for the interview and he said no. My question to the forum is that should he get a lawyer to close his asylum case or what are the options for him to follow end the case..
 
I would highly not recommend to handle it like 'do-it-yourself' project.
 
I know he needs a lawyer when he get here this month or next month but when someone refuses to go to an asylum interview, does the case get closed, dismissed or they forward to IJ for deportation proceedings or something.. Question now, if his name is in the deportation list would they stop him at the airport even though he has a valid business visa?

As far I know if one don't show up IJ automatically proceed that as deportation therefore it could very well possible him be denied at the port of entry regardless he has visa.
Although we obtain visa to enter the country but USCIS has full rights to decline that.

No wonder they say asylum is complicated. I only pray that his name is not on the list of deportation list.

He IS on their deportation list. When he went back to Africa, did he surrender his initial I-94? Do the immigration authorities know he left the country? Your friend is really an airhead and disrespectful to USCIS, you don't just apply for asylum and then not show up and then go back to your country and ask for different kind of visas to go back. Out of respect to the people's time here and the immigration system, your friend should have shown up in person and dropped the case and told the USCIS he was planning on going back to his country on his terms. He didn't and now he is going to have consequences and for a good reason. Because these kind of frivolous applications clog the system, other folks who are desperate and have geniune asylum cases, waiting for your years for their cases to be approved.
 
My friend came back to the New York with no problem during the winter time in 2005.. I know he was here for about 2 months before he went back.. He had no problems at all.. I also know there was a time he came back in 2005 for about a week and went to london and came back for 3 days and had no issues.. he did not hand over his initial I-94, i thought that should remain in your NP. when he comes back i will ask him more questions..

Just curious though, i had a similar experience though..

1996-- called for an interview but i did not show up
1999---called again for an interview again but did not show up again but no show at all.

2005--they scheduled me for an interview--

Now what if i did not show up for my 3rd interview would they have done one of the following to me

1)Refer me to the IJ for deportation proceedings
2)mail me a letter of deportation without IJ'S APPROVAL
3)mail me a letter resheduling me for an interview.

I don't know the answer to your questions, but I was just curious, why didn't you show up for the interview? Twice??? :confused: :confused:

I thought it was not neccessary to go, i dont know i just did not care about it.

Are you like kidding us all here on this forum? If not, you'd better stop telling us about your prank calls or you will make a lot of people angry.

I have been a member here for more than 1 year.. Why would i make things up or play pranks on the forum.. My friend was here in 2005 with no problems, Port of entry did not say anything to him about deportation until he went to renew his visa in africa and the officials informed he had an asylum case.. I did call the 800 number and i pressed option 3 to see if the IJ made a decision on his case.. I just want to know what are his options to solve the problem

INS calls you for an interview, an asylum interview, which obviously is a necessary part of the process and you did not care about it? You say you thought it was not necessary to go....sorry, but I have a hard time believing that you can be that naive. Any request from INS, whether it be a request for more docs or a request for an interview is someting "necessary" to respond to. I wonder what was so important for you on that day that you did not bother with the interview.
 
It remains a mystery to me why i did not go but i recall the day i was suppose to go the interview i was at exgirls house just chilling and i said myself oh well whatever happens so be it.. For some reason my mind just kept on telling me the worst they will say is go home.. After i picked up my approval letter, i kept on saying to myself that it was the will of God for me to be approved in 2005 not 1996 or 1999

It was not "the will of God" for you to be approved now. You could have been approved in 1996 also; it has nothing to do with God's will. You could have been a US citizen by now, but instead you had chosen to chill with your then-girlfriend on the day that you were supposed to show up for your interview. I mean your reasoning why you did not go to the interview is just odd. Unbelievable.....But hey, that is your life, so good luck with the rest of it.

May be i would have been a citizen but things happen for a reason.. I made a choice and i am living by my choice.. This is life, you loose some you gain some.

This is complete nonsense....you apply for asylum because you FEAR for your life.

We're serious people here....and what you're saying is just rubbish...

The IJ put him on deportation order april 17th 1998 but he was in the US at that time.. I will have to ask him if his visa expired already in 1998(i am sure his visa expired already but i will ask him). He left the country in 2003 to return back in 2005 with a visitor visa.. I asked him on the phone again and he said he went to the asylum interview but got denied and he appeal the case but the day he wanted to see the judge, he told the IJ he was not ready so they rescheduled him but he never went back and this explains why the IJ issued a deportation order on him...
I will find out if he did a bio during his application..
 
I haven't been back in 6 years....and won't return.
If situation changes....I will leave the US overnight....go back....enjoy what I inherited from my family.

Until then...I'll gladly work for minimum wage and kill time here.

I don't care about pranks on this forum, I do care about you and your buddies clogging the USCIS system while some other good people on this forum are forced to wait. They wait for their genuine cases to be resolved for years, separated from families, working hard and paying taxes. So I think your option to go back on that couch and contemplate further about life. Too bad your friend didn't have any problems coming here again. He should and I hope the new law will help in securing his visa denial.

I dont see what the problem is myself and my friend did not clog the INS SYSTEM.. Dont blame me for following INS rules that allows someone to reschedule interviews and appeal cases. Dont hate the player hate the game..
