Emergency appointment!

I had my H1 extended a few days back. The mistake I had done was that I booked my tickets to Indiain march 1st week and returning in the last week of march thinking that I could get an emergency appointment in Chennai or elsewhere.

Now, I went through the whole aplication process and now it shows that the earliest appt is in delhi on April 19th.

Can anyone reenter the US with approved 797. My visa expires on march 31st and I plan to return on 24th. Your responses are appreciated. Thanks

by returning no new visa stamp you are leaving it to the discretion of the immigration officer to stamp your I94 thru the end of your new I797 or march 31st. they may give you a grace period of 15 days or so after march 31st. but this is attheir discretion.
then after re-entering you and your employer and lawyer have to hurry up and file for extension of stay beyond the last date on your I94.

just thoughts based on my limited knowledge and not legal counsel.
