Hello Everyone,

Is there a way to get AP in case of emergencies.. ? One of my family member is sick and I might need to travel. We filed for our 140, 485 and AP just one month back. Can we get the AP from the local INS office..? Please reply..? Do INS require us to submit any proof of emergency.. ? Please reply.. URGENT

-- You need the I-485 filing receipt and AP filing receipt, you can try local BCIS office but they may ask any proof for Emergency, try to get letter faxed by a doctor from India to you and show it to the local BCIS officer

**** You applied I-140 and I-485 only one month back, if I-140 has any RFE they may not give you AP check BCIS online status of your I-140 punch the EAC or WAC or LIN# and see the status. If I-485 is denied when you are out of US on AP then AP will also be denied and you will not be able to enter US (very less chance as they are not looking at I-485 for 18-22 months after filing) don’t you have H1b approval? If yes you can get H1 visa stamped in India and enter on H1 status
