Suggest me:

My I485 was applied on Jun 10 - VSC. I'm on H4 visa. My current H4 visa expired in AUG.2002. The extension for h4 was applied before , but I have not yet got the approval.

I wuld like to go to india, I SEE 2 choices

1) Take Emergeny AP and TAKE OFF in JULY which I would like to do.
2) Apply and Wait for the AP Approval and then go.

I wuld like to know the ISSUES / PROBLEMS that might come in case1 above.

There is nothing like Emergency AP, as far as BCIS is concerned. They do not consider personal issues as a valid reasone for Emergency AP, except death of an immediate family member. Unfortunately you will have to apply for AP and wait to travel till your AP is approved or wait for H4 approval.
 
If your spouse is still maintaining H1 status you can get H4 visa stamped from consulate in your home country and can enter on H4 status
