Why EMC is reluctant to appeal.

I spoke to the lawyer and also to the HR person. They told me that EMC has laid off about 2000 Software Eng accross the country and
in order to apeal, EMC has to compare my skill and qualification against each and every software eng. they laid off. HR does not have enough time and resources to go through all the laid off employee\'s skill and qualification. Another thing HR is worried about is if the DOL consider the case as NON-RIR then EMC will have to post News Paper add and with this job market they will get tons of applicant, EMC just don\'t want to go through this hassle. HR also told me that one of the contrator who got laid off saw an add on the HR board for a sofware eng and he suited EMC for laying him off and hiring a forign worker, I do not know how true this was. Please add if you have any suggestion becuase my dead line for apeal is getting very close.

But I have noticed a very strange thing for EMC cases. EMC cases have issued NOF but there is no notice of extension or denial...
See the following cases.... Till date there are 23 EMC cases with NOF\'s

I do not know for sure but at least if they are not processing EMC cases they should deny it. You can process labor again after 6 months if it is denied. Ask your HR manager & lawyer. Have you got any letter from lawyer about NOF? Please keep us posted.

this is not good !! I was thinking that they are atleast fighting the NOF\'s.. With the DOL not even denying the cases, we now have to wait for the DOL to first deny the case, wait for 6 months and then retry the whole process
really sucks if you ask me.
