Email message after FP

Hi there,

I just received the following email message from USCIS:

Application Type: I485 , Application to Register Permanent Residence or to
Adjust Status

Current Status:

On November 20, 2004, the results of your fingerprint review for your I485
Application to Register Permanent Residence or to Adjust Status were received,
and processing has resumed on your case. We will mail you a notice if further
action is needed, or when a decision is made.

If you have questions or concerns about your application or the case status
results listed above, or if you have not received a decision or advice from
USCIS within the projected processing time frame*, please contact the National
Customer Service Center.



Can someone please tell me on average what the time span is between receiving this message and haveing your I-485 approved?

Although some cases have been approved shortly after the FP was done, in general this seems to depend much more on your I-140 RD (or LC PD for labor substitution). Look at the I-485 tracker / scanning threads or www.immigrationwatch.com to get an idea of where things stand currently.

My I-140 RD is 11/07/2003. I don't know what you mean by LC PD for labor substitution. I am a novice when it comes to immigration terminologies.

This might not apply to you but labor substitution is when you use the Labor Certification (LC) that was done for someone else at your company (and not used because they left etc.). If you use labor substitution, the USCIS uses the LC's priority date (PD) = the date the LC was filed to determine when the case is processed. Otherwise (for most of us), the I-140 / I-485 receipt date (RD) is the determining factor (I'm not sure what happens if you file the I-140 after the I-485).

For your RD, and assuming you didn't use labor substitution, you fall slightly outside the Apr - Oct 2003 range of cases that are being handled at one of 2 VSC locations. That location is supposed to complete that range of cases by March 5th 2005 (in theory...) and if so, they might start with Nov 2003 cases after that. If these assumptions are correct, then you would most likely be processed around April 2005, earlier if you are lucky, later if you are unlucky.
