Eligible to apply for DV ?

If a spouse is already in US by way of using DV Visa then the other spouse who for some reason did not use the DV Visa and applys for subsequent DV lottery and gets selected - can that spouse enter US without causing the first spouse any legal problems.

Bit of clarity in what i mean. A couple were selected and granted DV 07 visa. The wife who is principal winner entered USA first and hence got GC. The husband did not enter US by the Visa expiration date hence loosing the GC opportunity.

The husband and wife are still legally married even though they now are in 2 different countries. So for example if the husband applys for DV 09 and gets selected, What complications will it cause the wife who is already GC holder?

Yeah i know everyone will say why didnt the husband just use the visa in first case. Its a long and sad story so i dont wanna mention it.

Will appreciate your opinions.
 
I think should not be a problem to apply since, not all but many of the people that apply have some relatives or family mambers in USA. Would be a problem to win DV cause some play 1 yr and win and some 10yr and do not win. In mean time you should try to find other ways or alternatives how to go to USA. Since once you got immigrant visa, it seems any non immigrant visa is not an issue.
 
yes, the other spouse can definitely play, win and get a DV visa through the next lottery. Even the spouse who already won DV and became a US resident, can play, win and get a new immigrant visa through DV.
