Eligible by nationality and eligible by marriage - how many applications?

Hi All.

My wife is Malaysian and I am British. She has completed an application in her name with me listed as the spouse. I know that I am eligible based on her nationality; do I have to submit my own application or is it automatically registered through her application. It doesn't specify in the DV-2021 instructions but does mention that multiple applications will be rejected.

Thanks for all your answers, Phil

That application has her as principal applicant and you as derivative. You can submit a second application with you as principal and her as derivative, using her country of birth as your country of chargeability.

You can also submit a separate entry as the principal applicant based on your wife’s birth country, that is not considered as multiple applications. Right now you don’t have an application submitted, only your wife does with you as a derivative.

Yes, read the instructions..... right there on page 1:

If you were not born in an eligible country, there are two other ways you might be able to qualify.
 Was your spouse born in a country whose natives are eligible? If yes, you can claim your spouse’s country of birth – provided that both you and your spouse are named on the selected entry, are found eligible and issued diversity visas, and enter the United States simultaneously.

By the way when you guys all say British, Malaysian, Lithuanian etc I assume you realize it’s country of birth and not current nationality that is relevant.
