Eligibility of NIW

I work as a contractor in a state governement. I am a computer programmer.
Am I eligible to apply under NIW? If i can, how good are my chances of getting my i-140 approved and what documents do I need?
Please advice.

What stage are you at? I got I-140 approval early Dec. and filed 485 one week ago. Good luck.

For NIW, an M.S. degree is required. Other qualifications are similar to those of EB1-OR. Finally your work must be in at least one of 7 or 8 NIW areas.

I am 3 months ahead of yours, I did one EB1, nothing else.
I hope everything goes very smooth for you. I saw lots of good comments from you in the web site.
I asked the degree, because NIW petition must have advanced degree, as you said, at least MS.

Hi, Sivaa:
I think you should try to get your labor certificate as soon as possible, for EB2 or EB3, not NIW. The first requirement for NIW is you must have advanced degree, at least a master; even people with master degrees, most of them go through labor certificate, it is much safer, too.
