Hello to all.

Is anyone familiar with efile form I-539 for extension of I-94. My mother-in-law's I-94 is valid till May 06. She has a 10 yr multiple entry visa. I am thinking of Efiling this week to request another 6 mths extensions. Here are my questions:

1) What supporting documents do I need to send USCIS.
2) Will I get a receipt number right away from the website.
3) Which service center do I need to send supporting documents. We live in Chicago Illinois.
4) Do I need to send any original documents to USCIS or will photocopy work fine.
5) In case extension is denied, how much window will my Mother in law have to return back to India. Will this impact her next visit after 7-8 months back.

I will appreciate answers from the experts. Thanks in advance.

Most important information is the reason for the extension
An extension needs to be requested for extreme emergency cases and situations beyond control. Your MIL would be risking her visitor visa if the extension is denied and she stays past her original I-94 date. There is "NO GRACE PERIOD". If she overstays as a result of her extension denial, her next visit is upto the officer at the POE whether to let her in or not.

Secondly a visitor needs to spend more time in their home country than the U.S. For eg if a person spent 6 months in the U.S, he/she needs to spend atleast a year before coming back again. A person spending 1 yr in the U.S is actually LIVING in the U.S not VISITING

If u don't have a strong justification for an extension, don't apply. But it is your call in the end.

1 Will I get a receipt number right away from the website.
U will get the receipt after 1-2 weeks
2 Which service center do I need to send supporting documents. We live in Chicago Illinois
Look at the USCIS website for service center.
3 Do I need to send any original documents to USCIS or will photocopy work fine.
Photo copies are fine

Sorry for the late response. The reason for extension is due to a family reunion. My MIL has 2 sons and they are both Citizens here. She does not really want to stay here. But due to an important family event occuring in July she wants to apply for extension.

I filed the extension today via efile. However I made 1 small error. There was a question:

If you answered No to 3g, fully describe how you are supporting yourself, include the source, amount and basis for any income in the space below:

I left the text box blank because all the other questions suggested to only fill the text box if the answer is Yes. This was mistake. I do plan to mail out all the supporting documents to California Center tommorrow including I-134 with copies of bank statements etc. Could this lead to a problem. I have no way of going back and correcting the form as it has already been submitted. Please help..:(

Good luck. I am pretty sure that is the most common extension request that USCIS comes across. Keep us posted on the adjudication.

Can you also answer my other question about the error during the efile. Is that a big deal. I will keep everyone posted on the outcome.

Mail it in. Worst case, you may get an RFE/RFI.

Thanks. Also we have a family friend who did the same thing and he did get an approval from California Center. Same situation. Son is a citizen and mother wanted to extend her stay. She did not want to stay here permanently and had a 10 yr visa.

He mentioned this in a letter to USCIS and it worked for them. In the letter he stated that she is eligible to be sponsored for Green Card thru him but she is not interested at all. I guess it worked for him..So lets see what happens for us...
