I have got iEAD and started using it. My wife's H-4 expires in sept 2003 and she does not have iEAD. Since my H-1 status in longer valid what would happen to my wife's status which is dependent on me? Does she need to get iEAD as well or pending AOS status will keep her in a legal status? our I-485 RD is 10/4/02.
I will appreciate your comments on this.

A person who has filed the AOS is now considered in period of stay authorized by the Attorney General.

Making an application for iEAD or otherwise is your decision and it doesn't affect your legal status.

Hope this helps. I am not an attorney and this is not legal advice. Please consult your immigration attorney for further clarification in this matter.

Regards,

Since you are using your EAD, you are not in H-1 status. Since you are not in H-1 status, it is not possible for her to be in H-4 status. You are both in ajdusting status and that's fine as long as you do not leave the US. You (and your wife) need AP if you want to travel internationally and must maintain an EAD if you want to work.
