Effect of Change Of Name on the green card and H1

Hi,

Before coming to the US, my wife has changed her name and it was published in the gazette. However she did not change her name on her passport. But on my son\'s passport, her changed name was given.

She came here on H4 and subsequently got H1 and SSN with her old name. Now I have applied for Green Card and I do not know what problems would be there since my wife\'s name is different in my son\'s passport.

Please suggest me the best course of action. If she applied for a new passport with her changed name, does she have to apply for a new H1 and SSN ? Does she need to changes her name on all the existing documents and certificates too ? Finally what will be the effect on green card ?

Any directions towards the right path are greatly appreciated.

Some sequence in the events not clear

If your wife chagned her name before coming to the US, why the old name was used for H4, H1 and SSN?

1. She might have to apply for new passport.

2. If I am not wrong SS Admin allows change of name from maiden to married etc.

3. An ammended (or new) H1 too may be needed.

4. Depending on how far down the road you are in your H1 to GC process pl try to get the name change consolidation ASAP.

The reason why she could not get her name changed in the passport before coming to the US is very simple - procedural delays at the Regional Passport office, Mumbai. Even after a month things where they were and she had to leave for the US without name change in the passport. And immediately after she came here, she got a job, so had to apply with the existing passport with old name.

To keep things simpler

On second thoughts go with the old name used for your wife throughout the GC process.

Apply for a new passport for your son with old name of your wife. This is less hassle because both SS and GC process are not dependent on your son\'s name!
