Education mismatch - on LABOR

Hi,

I have got one pre-approved labor from a different employer and the education requirement on the labor is "Bachelor in computer science or computer engineering", but I have done my 4 years "Bachelor degree in Electronics and Communication engineering" in INDIA.

My employer evaluated my education credintials and it says my education is "equivalent to U.S.Bachelor of engineering".

I am not sure whether I can use that labor or not.

Any help is appreciated.

Thanks.

It would have been fine if the labor said-
Bachelor in computer science or computer engineering or equivalent.

If the labor takes a short time from Ur state and if you can go on for sometime with H1B - better file for a new labor.

If U do not have time in Ur hand give it a try with preapproved labor.

srnag,

Billtoo may be right. I had the same case as yours (same degree, 5 yrs BSECE from the Philippines). However there is a slight difference on the LC:
In my LC, it says

"BS Computer Science or related field or Math or Engineering"

I never had a problem with it, although mine was with TSC. You might want to discuss it with your lawyer, see if an LC ammendment is possible (per Murthy's website). Goodluck!

Thanks rgeneblazo.

I will talk to my attorney and find out if LC ammendment is possible.

Is pre-approved LC education amendment possible?

Appreciate if some one could inform if we can amend the educational requirement in pre-approved labor?

Thanks
