Education Matching on Substitute Labor? EB3 or EB2?

Hello Gurus,

This forum has a lot of very good information information. Thanks in advance for your suggestions...

Here is what the substitute labor says:

Part 14:
Grade School - 8
High School - 4
College - 4
College Degree Required - Bachelors Degree or Eqvl.
Major Field of Study - Computer Science
Experience Job Offered - 5 Yrs
Related Occupation - 5 Yrs

I have a 4 year bachelor degree in Electronics and Communication Engineering with five years of experience till priority date. Can "Electronics and Communication" degree be substituted for a Computer Science Degree?

If it can be substitued, should it be filed in EB2 or EB3? Would it be safer to wait for the priority date to be current in EB3 and then file in EB3 or does it make no difference?

I think it can be, but you should get an education evaluation done to be on the safe side. It would have been ideal if the the Major Field of Study said "Computer Science or Equivalent".

The requirements for EB2 are Bachelor's Degree + 5 years of progressive experience. Since the LC qualifies this condition, it can be used to file under EB2 category. Also, you need to be a little careful based on which service center you apply to. I know that Nebraska is a bit finicky about educational equivalency related issues.

I am planning to apply in California center. Is it also too picky about the education match. Would it be better to apply in EB3 since I heard it gets less scrutiny?

I would suggest going with EB3 as the Labor just about meets the EB2 criteria (Bachelor's + 5 years). Also, I have seen lots of people getting RFEs lately to convert their category from EB2 to EB3 causing further delay in 140 processing. But also consider the fact that if your priority date is retrogressed too much then it might be worthwhile taking a shot at the EB2 category. Max they can do is send an RFE to convert from EB2 to EB3. You don’t have worry about time in that case because your case can’t get approved unless your priority date becomes current anyways.

I'd say give it proper thought and also consult your attorney for advice.

Exp matching Subs Labor

Subs labor is for a DBA....
installing designing creating and maintaining Databases like Oracle and SQL on Windows or Unix...


I have Java Exp dealing mostly with Databases (Oracle and SQL) to use JDBC to fetch and arrange and organize data... Also, design table structures, DB Backups and other part of DB jobs have been in my Expereience...

Is it a good match ?? with good chance of I-140 approval?

...The Education requirements match fine...

Be careful. Call and talk to the evaluation agency and ask them if they consider it equivalent. If they won't talk to you - go somewhere else. Some are reasonable and some are very difficult. Go to google.com and do a search for ... credential evalation ... and call a few until you find one that will tell you what they are going to do.
 
Subs Labor

Hi all,

The education qualification on the aproved labor cert are:
Bachelors and Any major field of Study...I have a bachelors in Electronics. Do you still feel I should get education eval. done and attach it to the I-140 ?

My main concern is the Job Description and Job TItle....
Cert has - Database administrator Code - 15-1061

My Exp letters state I am a Software Engineer (Code 15-1031)..HOwever, in Labor Department Website (flcdatacenter.com)they do include Database Related work in Job Code 15-1031....
 
I aconsiderring joining a company which is willing to provide me Substtitute labor.

1. Does the total number of employees int he company matter for I140?
2. Do I have to be on the payroll for 3 paychecks before the company can apply for I-140?
