EB3 Visa Nos:October 2005 Predictions!!!

Would like to start a discussion on what everybody feels is gonna happen in 2005. Till June 30th 2005 the dates for EB3 were retrogressed to June 2002 does anybody think that they might go further back in October 2005 or someone has a different opinion or something
 
Entirely depends on how many backlog labor cases will get approved till the end of september. My Guess: might not retrogress less than Jun-2002 for few months. at the same time i dont think will move more than December-2002.
 
I am thinking that if NBSC catches up with all the EB1s and EB2s with in October , we might see an imporvement in EB3 , is it not ?
 
i feel they will open "other countries" except India, chinna and Philli for EB3. I really do not have much hope now in this year. :mad: my PD is Jan 03 and EB3 india. I am really thinking of migrating to canada or europe now.

Yes I have set a cutoff date for myself too ..till January '06, if nothing hapens I am planning to get out elsewhere.
 
Heard that EB2 has alreeady retrogressed, possibly to 3 years before. Next visa bulletin will reflect this. Now NSC workers can go back to working on corn fields fulltime.
 
I do not think the visa numbers will be allocated in plenty this Oct 2005.

With the guest worker program coming soon.. The visa number might be diverted in that area.

So I guess the waiting will be longer.

I somehow think EB-3 numbers will move significantly if not become 'current" in oct-05. May be its just my optimism/gut feeling.
 
On Oct 05, the retrogression date will reset to Jan 02.
More Back Log labors will be approved.
By June 06 the visas will become unavailable.

On Oct 06, the retrogression date will reset to Jan 02.
More Back Log labors will be approved.
By June 07 the visas will become unavailable.

On Oct 07, the retrogression date will reset to Jan 02.
More Back Log labors will be approved.
By June 08 the visas will become unavailable.

……………… and it goes on.

Disaster Hits the EB-3 Category; Could EB-2 Be Next?

Please read a paper on the Shusterman’s immigration web site, July 2005 (http://shusterman.com/siu.html#1). Some important extractions from the paper are listed below.

About EB-3: “What happens to the EB-3 category on October 1st, the beginning of the new fiscal year? … Just as the H-1B cap fell from 195,000 to 65,000 last October, the total number of EB green cards will fall from 249,000 this fiscal year to 140,000 in the coming fiscal year. ... In all probability, persons in the EB-3 category will face multi-year retrogressions. This means that only people with extremely old EB-3 priority dates will be able to adjust their status.”

About EB-2: “Since the CIS can no longer approve EB-3 adjustment applications, Service Centers have turned their attention to processing adjustment applications in the EB-2 category ... The predictable result will be that the EB-2 category, at least for persons born in India and China, will soon retrogress, possibly as early as August 1st.”

About EB-1: “We don't expect the EB-1 category to retrogress any time soon.”
 
Guys, I am in the same boat even with a priority date like March 2002. I have been spending sleepless nights for the last year and I feel like its time to say enough is enough.
Even with good education and experience and the fact that I have been living here for more than 8 years, didnot get me PR! God why are you punishing me??!! I am planning on moving out so that I will have peace of mind

Shusterman's report is interesting.....
EB3 will retrogress multiple years....huh....couldnt he do better than that ?
I havent seen a PD older than 2000 .Most of the cases even in BECs are 2002 cases ...So,PD will not go below 2001.WE all know it will NOT be current...
It is already retrogessed to 3 years. Isnt it the safest statement to say PD will retrogess to multiple years . Could you pick a number Mt Shusterman (3 ,4 or 5 yrs) ????

We can promise you one thing: Qualifying for permanent residence under the EB categories will be much more complex in the future than it has been in the past. This may be a good time to strategize with your immigration attorney.
 
Quite clearly the EB3 - Tech Workers will be still unavailable when Oct 2005 bulletin comes along. EB3 - Tech worker category will remain unavailable as long as there are Schedule A workers applications as they get the first priority according to last months ruling.
Maybe in another 4-5 years when the demand for Schedule A Nurses is satisfied the EB3 - Tech workers will get the remianing unused Visa Numbers.

It does not matter how many EB3 labor approvals are dished out by the backlog centers the EB3 will be unavailable for a long long time. Even if there are '0' approvals from the BEC in the next months the Visa numbers are not going to be available.

I am bracing myself for a long haul with renewing the EAD every year.
Dont get any hopes for the comming October, maybe for Oct 2008.

guys , dont know what i have to say,
some people who did Substitute labor are really lucky guys and think about those guys who applied their original labors in 2004 and how much struggle they have to go

take myself , came here 8 years back did 1st labor in 2001 from pretigious financial firm in NY city, got layoffed in 2004 ,my case still in state of NY at that time.
a NJ firm did my fresh labor in 2004 ,got it in 4 months,applied 140/485 and just waiting for my visa number to be current..

dont know about my future...but those who did Sub-Labor are very lucky ....
 
There is hope...EB3 visas may become available before October

My lawyer thinks some numbers may open up before October

annual employment-based preference immigrants is at least 140,000.
EB1 40,000 this never get's used up
EB2 40,000 not used up yet
EB3 40,000 (WILL GET ALL THE UNUSED NUMBERS FROM EB2 AND ALL THE OTHERS)
EB4 1000
EB5 FAR FROM USED UP...

BECAUSE the per-country limit for preference immigrants is set at 7% employment-based preference limits, i.e., 25,620.
The dependent area limit is set at 2%, or 7,320

FOR THESE DATES EXPECT IT TO RETROGRESS TO JUNE 2002 SO IF YOU STARTED THE PROCESS BEFORE THEN YOU'RE OKAY OTHERWISE GET A GOOD JOB AND GET READY TO WAIT

EB3s might get GC faster is they start their Phds now and reapply in EB1 after completing the thesis.
 
Looking for New Hopes...

If the EB3 visa numbers do not become available in near future,
Is CP an Option?
I have been here too long and do not have patience to wait for another 4 yrs
Is there any way you can preserve the I-485 while being away from US
If this process is based on future employment, can one join the sponsering company after getting the Green Card
Any thoughts???
