All ,

I have got my labor recently in EB3 Category.
But I am eligible to apply my labor in EB2 category.
Since my lawyer did not do the evaluation at that time ,
my labor was filed in EB3.


Recently i have evaluated my educational certificates and the evaluator
evaluated to B.S computer Science. And since i have 9 years of experirence , i guess , i am eligible to file in EB2.

Now , ...the question is can i convert my filing type from EB3 to EB3 while filing my I-140 and 485?

Please throw some light on me....

My lawyer converted my I140/485 application to EB2 from EB3 without my knowledge.

The result was both my application were denined and I had to refile.

I had BS(3 Years degree) + 9 years of experience at the time of filing.

So be careful before such taking decisions.

Do you have only BS+9 years or Do you have any other educational certificates also , which make up your 4th year?

For EB2 you need to have BS(3years)+ 1year PGDCA or equivalant + 5 years.

Do you have that One year Degreee ? Or did he file your application just with BS(3 years) + 9 years of experience?

EB2 labor requirement has to be bachelors with five years progressive experience or Masters. If labor has this requirement then you could file in eb2. If labor doesn't have this requirement then you can't do it.

I already got the labor in EB3. You mean to say that while advertising , it supposed to say that the eligibility for this position is EB2?

you said that you refiled the 140.
Did you use the same labor to file 140 or did you go for a new labor.?

what are the reasons did they mention for the denial of your 140 and 485?

Do you mean to say that using the same labor, one can file more than one I140( say in EB2 and EB3 if one is eligible for EB2 also).

My 140 is approved in EB3 Category in Box 14 in my Labor application it is listed

Master's Degrees, Bachelor's Degree, Diplomas, Mark sheets and Reference letter


In Box 15 It is specify Structured systems analysis, design, development, testing, quality assurance, implementation, integration, maintenance and support of integrated client-server sytems ............

Whether I qualify for EB3 to EB2 Conversion, My case is Labor Subs.

But my company policy is only apply I140 in EB3.

I also have my last W2 with 86K

Please let me know the process of conversion
