EB3 to EB2

Hi -

I am confused about the category criteria. I have masters in Comp science and have 5 years of experience in US, with 4 years beng with the GC sponsoring employer. I am currently a project manager with my current company and finally they agreed to file for GC. But I was very surprised that they were filing in EB3 category as the job requirement does not require masters degree. Is there a way to still or a criteria to convince my boss and company attorney to file in EB2 category?

Hi,

You'd better talk with your attorney. But if your job position generally requires only BS (as a standard in your industry), then if you try make it a MS required your PERM will get rejected. Remember that the purpose of perm is to check the availability of US citizens with minimum qualifications. If your company tries to unfairly increase the standard just to keep you, that's not going to work.

If your masters is from India, Then it usually don't make an US MS equivalent.

I am not an attorney and this is my general opinion. Talk to qualified person to get professional advise
