EB3 to EB2 - some questions

My Priority date is Dec 2002 in EB3 - world wide. My I-140 is cleared. But due to retrogression, I could not file I-485. I need to get EAD and AP asap. I cannot get it with my EB3. And the prospects also do not look good in the future.

EB2 world wide is going current. I want my company to file another green card case in EB2.

My question is, can I retain my priority date of EB3 in my EB2 case?

I have B.Sc. Engg - 4 year degree with 8+ years of experience - 5 years in US with the same company. They filed 4 years ago in Eb3. Do I qualify for EB2?

Also, can I use my EB3 labor certification for my new EB2 case or do I have to go for another labor certification?

It does seem that you have to file for your Labour under EB2 again.

I wud like to know if the experience in your current company can be accounted towards your min 5 year experience for filing EB2.

Experience at your present company doesn't count.

Though I am not an attorney or anything, this is just my understanding!

incorrect statement. this is most widely touted claim made by many on this forum.

what is your basis for this statement?
