EB3 to EB2- H1B in last year

Hi,

I am currently working with Company A, who got a PERM approval under EB3. I 140 approval is not obtained yet. PD is Jan 2006. Company A will not file PERM under EB2.
This is the last year on my H1B which expires sept 15th 2007.

I want to move to Company B, who will file PERM under EB2. Is that a good idea? Will I get my 1 year extension for H1B, if I join Company B?

Can company B file for PERM under EB2 then get I-140 approved, and then can I join Company B?

Any help appreciated.

Thank you.

Not good idea at this moment. If A cancelled LC, you lose ability to extend H1 toward 7th year. Unless you are sure to complete LC+I-140 with B before the next Sept, it's better not to go that path.

THis is safer option.

You may want to wait until I-140 is approved with Compnay A and then using this I-140 approval you can transfer H1B for 3 years with Company B.

This is a good idea, as after I-140 approval you can get H1B transfer for 3 years. You can try for PD porting.

Good Luck.
