How many of the folks from the EB3-Rest of the World category have gotten their 485 approved ? Please post your PD and details.

EB3 ROW current finally upto March 01, 2006

Lets see if we get more approvals in May.
What should be done if your category becomes current ?
I-140 was approved in 2006, PD is Nov 2005, 485 was filed during VB Fiasco, August 9th 2007.

No finger prints have been done, as it has not been sent to us.

A service request to Texas resulted in ' you will be processed in time '.

Now that it is current, should I again get a service request or infopass, why I dont have finger prints ?

Bill- what is your service center ? I know of a few others (but they are Indians, not ROW) stuck on finger prints also. They have not yet been FP'ed.
 
I'm in SRC (Texas). My PD became current yesterday. Lets see if we have any updates :)
The processing time frame shows April 30, 2007.

RD: March 3, 2008
FP: March 28, 2008
LUD Changes: March 3, 6, 28, 30

Hi Everybody,
I have EB3 I140 approved (PD Oct 2005) and now the Visa are current to apply I-485 and others. And I have also applied for EB2 labor certificate recently but not approved yet. My question is, should I apply I485 based on my approved I140 or should I wait for EB2 labor certificate to be approved and apply I140, I485 and others based on EB2? Could you please advice me...

Balkhu - I would think your GC should be super close. My friend had nearly same PD dates and he got his GC last week. Do you know if your Namecheck is in the clear ?

Gocard - That would be your choice, but in my case, I just went for the EB3 category as my prewailing wage might not pass for EB2 ;) Second reason was I could not use Bachelors + 5 years with the same company. I took advantage and just filed. You have to think of the what if scenario - what if your EB2 gets RFE or rejected due to experience or prewailing wage etc etc. And the EB3 window closes. Thats just me. But some other folks could comment. Might help you make up your mind.

Could anyone please provide me information on the following?

a) What does 'info pass" mean.
b) What does "processing time frame" mean.
c) My PD is current. I read in this forum that the PD for may VB is going to be moved to November 01. Does it mean that my I-485 should be cleared by end of this month?

Any help would be appreciated.

What was the RD of your friend's application?

Even though my PD is in 2002, my RD is March 3, 2008. I think I might have to wait a long time. My finger printing was done on 28th of March and then I had LUD change on 30th. I am thinking that might be the day when they sent my application to namecheck. Have you heard anyone who applied this year getting approved?
 
Balkhu - I might have misspoke then. My friends PD was in 2002/2003 sometime, but his RD was in June 2007. His FP was done around 11/2007 along with me. LUD changes exactly after FP is done for most ppl. That happened for me too. You know its so hard to figure out how USCIS gives GCs. For eg. the older the PD, the quicker you should be in line to get GC. But then I have seen some newbies get GC earlier than old timers.

All the same, if your PD is that old, just be hopeful that the 'processing times' are also around your RD timeframe. My PD is current, but processing times are stuck in 4/2007. I mailed my application on July 07 (fiasco).

Isn't it true to say that all of our processing times are stuck in the same 04/2007 date? I didn't think that PD had anything to do with anything, other than being eligible to file for I485 application. Since they process based on RD, yours should come almost an year earlier than mine, right?
 
Balkhu - I believe PD is the most important key to the GC process. RD is something much more light-weight. PD determines if you are current and thus if you can get a green card number. PD comes and goes and retrogresses and therefore people cannot get their GC's. (consider all the Indians with PD 2001 in EB3 and they are getting GCs now). I am sure their RD are well within the processing dates ;) Anyone else can chime in if they have any other information. (if you are stuck in namecheck and background check, then thats a different issue, but with the new memo, again that case should be approvable within six months in theory).
 
I agree that PD can retrogress and it can determine whether your case is within processing window or not. But once it is within the processing window, then they process based on RD. For example, if PD1 and PD2 are both within processing window, then the RD of the two cases decides who gets green card first; regardless of the PD date in this case. What do you think?
 
Hmmm what you say makes sense, but I think when both PD and RD are current, PD should still take priority. The whole reason people wait in line is due to PD. But from what I have seen, there is no telling about any logic that USCIS follows. I am just hoping for now that I have my name/background check complete. I will call this week to find out.
