EB3 RIR to EB2 PERM

Gurus/Pandits of PERM process,

Here is my situation: I filed for LC last October,2004 under RIR, EB3 category in Connecticut. I have a masters in Metallurgy, but now I am working in a software company. I asked my lawyer to attempt to file for PERM EB2. He said its possible to leave the old LC application as I havent even received the 45 day letter and file for PERM with a new application and new job title as I have been promoted over the year.

My question is - Is this possible - if so, is it advisable to do so ?.

Please respond back as soon as possible as my employer feels its not advisable where as my lawyer is ok with it.

You can file a brand new PERM EB2 now. Forget about Eb3 one, time being.
