EB3 Retrogression

What the hack is now this hurdle come up ? I am still not clear what will happen to my case ?

My PD is Oct 31, 2002.

EB3 concurrent 140/485 ND - 12/12/2003.
FP is 5/8/04

Can anybody please suggest me what will happen to my case ?

Hi Ranvir,
don't worry.. you can change jobs after 180 days as per my attorney.. I know this is big pain.. but we have to go thru it.....
keep your hopes..

is that what Retrogression means...that you can change jobs after 180 days.
Other reading i did ..it says you cannot do it untill ur 140 is approved..no matter how many days its past your receipt date
 
i'm in the same boat. i got the confirmed info that they gonna continue processing 140 application for EB3 after Jan 1, 2005. i guess we have to wait til our 140 approved before change jobs.

Will they process I-140 for EB3 even if the application PD is after 01/01/2002? I understand that I-140 will be process only if I-485 is ready to process.
 
yes. some key person in the senator's office gives out this info and they just send out the memo from uscis. they will keep processing 140 for eb3 even though 485 can't be processed.

They have just discontinued this policy of concurrent I-140 & I-485 adjudication.
 
According to the latest info posted in www.immigration-law.com the new rule says concurrent "adjudication" for I-140 and 485 should be cancelled. My guess is that, though some centres like NSC and TSC have been adhering to this concurrent adjudication, now they cannot adjudicate I-140 till 485 is ready to be processed, hence I am guessing more I-140 approvals in the coming days.
