EB3 - PD after June 2003 cases?

Now July VISA Bulletin is current.

- What will be impact on PD after June 2003 for EB3 cases. Will USCIS approve I485 for people having PD July 2003 and later?

- Do they have VISA number for approval?

- Any EB3 cases got approval having PD July 2003 and later.

USCIS is approving EB3 cases with PD after june2003, I got approval notice email on 07/17, my case details are given below :

PD OCT 2003
RD DEC 2004
AD 07/17 (LUD : 06/27, 06/30, 07/16(card prod), 07/17(approval))

Please check the LUD on your case, if it is showing date of last week of June
your case would be approved any moment from now, Good luck.
 
Will they start approving again after updated july VB

Now July VB is current. Will they start approving again?
 
I think it's anybody's guess. People with PD before Jun2003 are still waiting.
Remember, more people with PD <= Jun2003 would be filing I-485 now. These might be people who missed the Jun 30 deadline.

I485 approval is not subject to PD. It is all based on RD.
I see a lot of cases that having a later PD than mine (but filed right before the 2005 retro) gets cleared.

My PD is 4/2003 ROW. I got my LC cleared 2 months after the retro hit and can't file it until May 07 VB.
 
Is there a memo/law regarding this?

RD than PD

One of my friends PD is Feb 2004 and RD Aug 2004 got approved by mine did not yet. Also my other friend heard from his lawyer that PD is applicable only to file 485 and once it is filed RD is the one considered for approvals.

I filed my 485 in July 2004, and now we filed for my wife's 485 on 07/02. So in such a case would they just attach her 485 to my file and use my RD?

IF I-485 is Approved Based on RD - What is the purpose of PD in VB

I hope every body can understand the heading.

Following are assumptions based (situations that have actually occurred in the past & situations that will most likely happen for retrogressed countries) on filings or inability to file in July 2007 or even before August 17, 2007:

1. Applicant Tom has a priority date of June 2003 under EB3 and is from India. Tom's Labor is stuck with the BEC and is not approved till September 2007. Tom may not be able to file till October 2007 VB makes his PD current and subject to his Labor being approved before September 30, 2007.

2. Applicant Dick has a PD of January 2007 and is from India under EB3 but his Labor is approved through PERM in July 2007. Dick files for I-140/I-485/I-131/I-765 on July 30, 2007 and his RD for I-485 is 07/30/07.

3. October 2007 VB comes out with PD for EB3 with a cut off date of 1st July 2003. Tom will file his I-485 on October 2, 2007 and his RD for for I-485 is 10/02/2007.

4. There could be many more scenarios that could happen from November 2007 VBs but to come to a conclusion on Tam and Dick's situations, let us assume that the VBs following October 2007 VB right till September 2008 VB will move the cut off date for EB3-India from 1st July 2003 to 1st September 2003.

Based on the foregoing assumptions, the BIG question is: Who will get the I-485 approved before September 2008? Will it be Tom whose PD is June 2003 but his RD for I-485 is 10/02/2007? Or, will Dick get his I-485 approved based on his RD for I-485 which is 07/30/07 (assuming his I-140 is approved in October 2007) and with a PD of January 2007?

My take on this scenario: USCIS is in BIG trouble if they approve Dick's I-485 based on RD in August 2008 and DO NOT approve Tom's I-485 before Dick's approval EVEN IF Tom is OK with FBI namecheck and all his documents are in order.

after 17th July 2007

What will happen after 17th July 2007. Will they approve any I485 or this is just to file I485. Do USCIS have any VISA number to approve I485 in July 2007.
 
They have already tagged visa numbers to all documentarily qualified cases in june & july1st, approvals should be expected for all old cases filed in 2004/2005
 
My PD is October 2003.I filed I-485 after a year because of retro.My RD is June 2007, I see approved cases with PD and RD!!!! from 2004, 2005, basicaly we all that filed in june will be stuck not publicly in the "pipe" until all other who filed before retro are cleaned.So all that game with the Current for everyone is just to take the attention off their necks and you will be stuck for years but with an application.I hope no body who filed in June doesn't think he will get GC this year! The most reasonable time is after 1 more year and a half.Ofcourse you need to do then again medical and FP.So MY action in that patetic situation is - I'm going to Canada and with the experiense from here already 6 years I'll have the life I wish for me.

I see your point, however there was an approval posting a few days ago. The PD was July 2005 in PERM EB2 and filed for I-485 before retrogression hit and that person was approved in 2007. And we know that there are thousands of people before July 2005 are still waiting. So in this case the PD didn't matter?
 
Why did you waste money in June by applying for AOS if you wanted to go to Canada?

Average processing time for retrogressed countries is 3 years, those filed in 2007 will get approved by 2010, if they have a old priority date it should be earlier than that.

1. Have you been proactive and agressive in calling USCIS after filing your case?

2. Have been in same address since you filed your case?

3. Have you recieved your EAD before 140 cleared?

4. Did you recieve an RFE for employment verification before 8/19/2006?

i applied EAD after 140 got approved

No RFE, 485 approved on 07/17.
