I'm creating this thread for tracking EB3 NOn-RIR case status from Philadelphia BEC. Please take a moment to share your info.

LC Sent to DOL : Yes

45 Day letter : Not yet

EB3 Non-RIR
PD: August 2003
DOL: Boston
LC Sent to DOL : No
LC Sent to PBEC: Yes
45 Day letter : Don't know

My LC was filed from NH not MA. It was sent to Boston DOL in January 2005.It remained in Boston DOL until September 2005 i guess and then all the remaining cases were transferred to Philadelphia BEC. Narrow miss - Unlucky me.
 
Guys and Gals from Boston DOL, Post your case details here. It would benefit everyone. I read on some other forum that PBEC was sending 45 day letter for cases with PD of Oct 2004. I would assume that those cases are not EB3 Non-RIR. \
 
Gravitation, One more question - Do you know if PBEC will ask people who filed Non-RIR cases to do the recruitment process again?

Yep. TR => Non-RIR.

My understanding is that you don't do recruitment process before filing for LC. The company sponsoring a prospective employee for GC conducts a hiring process supervised by a case office from USCIS. So, yes, you do the recruitment processs, but it's not "again" because there was no need to do any recruitment thrings before applying for LC. You do have to do the recruitment stuff if you submit LC application in RIR or Perm.

How long PBEC needs to post job add after receiving 45 DL?
 
Cases transferred to PBEC from Satelite centers (Boston ,Newyork, SF)

Does any know whats going on with the remaining cases that were transferred from Satellite centers to Philadelphia BEC?

Boston DOL was one such satellite center that was supposed to be processing LC cases till the end of 2005, but they transferred all the remianing cases to PBEC in september 2005.

Anybody here with cases that were transferred from Boston DOL to PBEC, please post your case details if you dont mind.

Recruitment is required for both RIR and TR/non-RIR.
The difference is that for RIR the recruiment can be done by the empoyer before the application is submitted.

whereas for TR/non-RIR it has be supervised by the processing center. First you submit the application then years from that you hopefully get instructions to do recruitment.

In the BEC scenario things have changed and its not clear how much of the old process is followed. Only PBEC seems to be touching applications that require recruitment judging from the ads that they started posting a month back in newspapers and online.

45 Days letter: Not received yet.. And if lawyer mighthave received it, I have not been informed yet.
