I am confused -- some one please do explain --- the status quo of this 'claim to fame path' --- EB3 ~~ the skilled guys with little less education.

Ok -- I am standing on that heavly populated Country Quota too.

Now, I intially understood that on Oct 01, 2005 they are going to release new Quota ... a fresh start I thought... new number will start.

So it was going to be Fresh new - 26K visa numbers for each country.

Ok EB3 had a little share of this -- But where did it all go -- even before Oct 01 arrived.

Did pre-1998 India guys are going to grab it?

Am not sure what your question is .....
Are you asking why the PDs retrogressed to Jan 1998 for India ?

If so do a search here - the numbers were released about 15 days back and there were lots of discussions regarding that.

Bottomline --> No one really knows the reasoning behind this .... there are only "conspiracy theories" floating around at this time !!

!

No Max .. my thing is who is going to consume the quota for EB3 -- if they some are saying because of the cut-off date only guys with PD earlier than Jan 1998 will be processed.

Now NSC is saying that they are processing 485 from Oct 2004.. That means that the newly released quota are going to be consumed by some of the guys waiting ... as there are very few pre 1998 guys left. So there will be good number of approval this new quater.. Oct to Dec 2005.

USCIS says that they continue to process the 485 even if there are no visa number.. If no visa number availiable then -- the application is sleeping till it gets its turn of visa number.. But the case might be approved and hence there is movement in the NOW processing date..

If all this month if NSC was doing 485 even for retro contries like China and India ... Oct we should see some decent number of approvals.

Do I make any sense ?

Mine is EB2 and RD is August 2003. I have done my finger prints Code 2 (in August 2005) and also Code 1 2 days ago. NSC had send a RFI for addtional document from my employer, we responded to them & they received the same on 9/1/05..
I do not understand what's the reason for them not processing the case. They send code 1 finger print notice only when your case is almost through. They can approve cases for 2004 but are they not processing pending cases of 2003. This means that at present they are just processing cases as per current date ( June 2004) and from Monday onwards they will stop this 2004 cases approval and start all over with 1999 cases. As mine is 2003, it means that my approval will come after atleast 3 years........................
Somebody started a thread which mentioned Indians fight like stray dogs, actually he should have started a thread which says USCIS officers sucks..............Do not blame Indians, start blaming USCIS people
