I don't mean to sound to pessimistic but things do not look good at all after this report. From the look of things they will keep moving the dates by a month each month and by Sept 06 we would have reached July-August 01. Thats if the dates do not get stalled in April 01. What will end up happening is that most EB3 visas will get wasted because they will go unused.

This process has deteriorated so much that there is just no point in even keeping up with it.

How sinister their plan is :

Waste / end up with unused visas yet again + frustrate , drive us to insanity that we either end up as loonys or flee out of the country.
 
EB3 India may get worse than this

I hate this bulletin. I hate USCIS. I am totally pessimistic now.

I suspect USCIS may retrogress EB3 from next month onwards too.....I believe now that my case will go stagnant for another 1 1/2 years...

AC21 is the only solution to get rid of my stinking employer...
 
485 Approval even though priority date not current

My colleague just received his 485 approval 2 days ago even though he is EB3 India with priority date in April 2002. Based on that, I was hoping EB3 India would move significantly forward in the April Visa Bulletin. All hopes dashed :(

Have there been other cases of 485 approvals where priority dates were not current ?
 
Few missing cases

These are very few missing cases. This happened before also. We can not prove that statistically more cases are approved even when PD is not current. They will be useful only to just add to more confusion........

Dude, tell your friend not to get too excited. They may revoke his Approval too.

This sucks. I was hoping I could put my going to Canada Plan on hold. This has lead to more uncertainity now.

I am getting pessimistic. I have a feeling EB3 will be stagnant next month and may become Unavailable soon. I think when they moved the PD by 1 yr last month, they may have received a rush of applications.
 
i have seen a similar thing happen with a friend of mine...he had a pd of aug-2002-india-EB2 ....but he got approved 3 months back....he has his Card now....

i think the officers who approve, not all of them are strictly following PD thing...

Fax to ur lawmakers...2 senators in ur state and one house of rep mambers...
tell them ur story in ur own words...let the letter has ur name address fone and email....
it takes 5 cents to fax..and 10 minutes of ur time
i faxed and i got reply from 2 of them already ...
guess we live in different states and we can cover a lot of people...tell them abt the bills pending....
take 15 minutes of ur time from bitching uscis and crying in this forum...
they goona hear us

What do you mean the visas will be wasted? Please clarify. They are moving slowly ahead right? I am in the understanding that already the visas were used up so that is why they are moving slowly forward...how can you say visas will be wasted. Please clarify.

Also can somedbody please help me understand why EB-3 is going slow compared to EB-2. Does that mean only that EB-3 people are a lot in number than EB-2? If there is another reason please help me understand it.

right now we have around 100,000 unused visas from last 4 years and IV is lobbying for that numbers to add for this years quota !!
 
is it 100000 or is it 50000. I thought out 100k, 50k has already been marked up for Schedule A workers.

The thought behind this is that the USCIS is keeping the priority dates so far behind in anticipation of a flood of Labor approvals from the backlog centers.

So in theory if the backlog centers dont dish out the anitcipated number of approvals for April 2001 PD Labors then by Sept 2006 the Visa numbers for EB3 will go waste nad unused. And if that happens, the USCIS will then push the PD's for EB3 further back in more anticipation of Labor approvals from backlog centers.

Also very few realise that the Schedule A workers also get a first shot at any available EB3 Visa Numbers, in addition to the 50,000 recaptured numbers they already have. It can be seen that, that is why they are current.

In short is useless to look for the Visa bulleten any more for EB3. The only thing that can save us is anything that immigration reform bill churns out in the next few month.
Else brace yourself for the long haul.

I do see lot of frustation particularly from EB3 India and China, I am just curiouse how many of you guys done something about it,

myself, I wrote to my local senators and also spoke to an Immigration correspondant from local senator office.

I contributed $100 to the techworkers group which is working with a lobbying firm

changed job using AC-21 and will be doing it once again if things works out my wife is working using EAD.

so my point is I can't do anything more about it and just don't want get frustated anymore.

Belive me guys this country needs us more than we need to be here,

You are lucky in a way because your spouse can work, you can change your job (AC21) and you can travel (AP) without fear of an H1 rejection at a consulate abroad.

You were lucky because you could file 485 when the PD's were current. Unfortunately many of us got our Labor Certified much later due to no fault of ours even though we had an earlier PD and could not file for 485 and thereby not availing of these incidental bfts like EAD, AC21, AP etc.

We are upset because the system is unfair. When ppl with similar qualifications, job, salary, etc got GC last year even with later PD (2002, 2003 etc) just because their labor came through whereas others like me with PD of 2001 had our LC's rotting at DOL wouldnt you be upset ??

There is nothing fair about this system. All said and done its a game of chance.

well said..most of these people do is bitch abt uscis and cry abt thier fate..
i have contacted all my lawmakers in my state and got positive response frm most of them...if all start contacting their lawmakers by fax or fone...we cud have covered the lawmakers in every state and make this immigration bill a law...
Guys..Cry your heart out in this forum..all u get is sympathy...contact ur lawmakers...u will get this bill apporved.

Your concern is valid. There is no fairness in the system. We know some guys filed LC in Wyoming, Maine got approval in less than 6 months and 485s in less than a year. I know one guy filed LC in 2004 and got GC in 2005. Those guys abused the system even they do not know where the wyoming/maine state is. However, if DOS still holds the dates, there is a great chance for wastage of visas at the end of FY. If any one files new 485s after april 2006, their 485s may not be approved befroe the end of FY, and thereby CIS may not able to request visa numbers for them from DOS before sep 2006.
