when did you file for AC21. you must have crossed 180 days mark before you applied for AC21? Was your I-140 approved when you filed AC21?

I am planning to file for AC21 as its just been 180 days after receipt date of my I-485. I-140 was approved 5 months back. Howerver I don't have copy of labor, 750A, 750B or approval copy of my I-140. Do you think I can go ahead with AC21 w/o any of these? My employer is not going to give any of those copies to me.

I did not inform INS when i changed employer. My I-140 was approved and i changed employer 170 days of filing I485.

You also don't have to inform INS as this isn't the requirement. Just go ahead and change the employer but make sure to get the offer letter from new employer that has same/similar job title and duties.

Good luck !!!

As I mentioned I don't have copy of labor, 750A, 750B, I-140 approval or receipts etc. So I don't know what duties, skillsets he has mentioned for me. Obviously my new job is also in IT. Do you think I can still go ahead for AC21.

I don't think you should go ahead without this information. Because if INS send an RFE for EVL, then EVL must have same/similar title and duties. You can actually get copies of 750 forms from FOIA.

You mean you did not proactively invoke AC21, you just provide EVL from new employer, right? What's in the RFE?

RFE was about medical exam. INS wanted us to do the chest X-ray.

If you did not invoke AC21, why did you call it AC21 case? It looks to me that your GC was based on your former employer and ahd nothing to do with the current one.
