EB3 485 approval, is it based in FP date or notice date

Hi,

Does anybody know how USCIS treats semi-concurrent and pure concurrent cases. My I140 is approved. waiting for 485. FP notice is may 2004, notice date is jan 15.

priority date is sep, 2001
I am bit worried about retrogresion, although it apears that it may not go back to my priority date.

The latest processing times for 485 suggests Mar 19. Is this FP date or notice date

You are safe related to the Priority date. It may take some time to get your 485 approvals, since your 140 is approved and didn't got any RFE, your 485 approvals also will come is pretty soon. They will follow the notice date for 140 if you did a concurrent filing. so in your case it is jan 15th.

My case ( ND 12th jan 2004) got approved yesterday 12/08. got emails today at
2.00PM PST. so cross your fingers your approval will come soon.

I am in the same boat

My EB3 I140 was approved on 12/6/04. I filed I140/I485 cocurrently on 12/15/03. I485 LUD is still shown on 10/27/04 which I believe it is due to mess update.

We are in the same boat. Hope we can receive I485 approval soon!

I had an RFE on my 140, after reply it got approved. Does that make delay in 485

Here is my details.

Substitute LC EB3 (Priority date June 30 1999)

140/485/765 RD 9th Jan 2004
140/485/765 ND 12th Jan 2004
765 Approved Feb 2004
FP done April 2004
140 LUD change 5/14/2004, 11/23/2004 ( 140 Approval email and status change on the USCIS web also saying the approval notice mailed on 22nd November'04)
485 LUD 5/25, 10/27, 12/09( me and My wife)
Kids LUD 5/25, 12/09
485 approval email came at 2.00PM PST.

since you didn't get any RFE for 485, My guess is that it is OK and mostly you will get 140 and 485 together.

since you didn't get any RFE for 485, My guess is that it is OK and mostly you will get 140 and 485 together.
