**** EB2-RIR or PERM ****

Hello Folks:

I need some advise from you.I surfed thru this forum , found similar cases as mine but cldn't get the RIGHT answer.

Here is my story:

I filed my Labor in dec 2004 thru EB2-RIR and it is moved to backlog center.
We received that letter and replied back also by asking them to keep the same.
Now I'm looking at various options in filing thru PERM.
I have follwing Q's ...pls type down ur advise for me.Thanks in advance.

1.Will I loose my regular RIR labor if i went ahead with PERM rpocess?
Some folks wrote like "I will loose it if my case got denied"...Can I maintian the same Date if it is accepted adn they cleared my Labor thru PERM?

2.Ppl here are saying that "You can NOT file 140 or 485 untill u get ur DATE though u filed/cleared ur labor thru PERM", Is it TRUE? If so wht is their DATE stuff here?

3. As of now thru backlog centers it will take mid 2007 to clear all the Labor cases itseems..What is the process that follows once we get clearence of Labor thru Regualr RIR process? Can we file 140 and 485 at the same time? OR again the DATE stuff comes into picture?

4.Which one will be earlier and advantegeous to me? Like:

Filing ur Labor thru PERM and wait untill u get ur DATE?

or

Wait untill u get ur Labor claered theu backlogcenters adn then follow the process of fling 140 and 485.

5.Basically can someone advise me whether I shld go for PERM or not?

I'm in total dilemma...Dramatically my confusion level raised Drastically after I gained some knowledge by briwsing thru these forums....

PERM and RIR both going have same scrutiny. If you believe your PERM get rejected, then your RIR also in the same boat. If you convert in to PERM, you will get approval early and can keep PD Dec 2004 intact. If EB2 retrogress to suppose Jan 2005, still you ca able to file your I 140/ 485, beat the guys who applied PERm from March 2005.

Difinetly , if 350,000 applcation in the BEC approved , dates will retrogress to years.

PERM, if you have confidence of your job description, prevailing wages and your attorney.Filing ur Labor thru PERM and wait untill u get ur DATE?

Well,,,if I file my PERM now, get cleared of it,have the dec 2004 PD date...then WHEN can i file the 140/485 combo?....I tried filnding those dates stuf here and there but cldn't locate that grid...

can somone direct me or write me abt the CURRENT dates for filing 140/485 OR approximate dates for me to file 140/485 (keeping me DEC 2004 PD date) ....Appreciate ur prompt help.....Thanks

MY FINAL q's:

1)Though I get cleared of my labour thru PERM do I need to wait untill I get my date to file 140/484?...

2)Is it advisable to go through PERM and wait there untill u get ur date to file 140/485


or


Just adhere to the good old RIR process from BEC and wait untill u get ur clear Labour adn follow the date to file 140/485


3) Does filing thru PERM brightens our chances in filing 140/485 faster?


Lot of Q's .... Need some good advise...
