EB2 PERM from H4 (MBA online graduate)

Hello everyone,

I’ve arrived to US on H4 visa, joining my wife who has H1B. Currently I’m enrolled in MBA online program, which I should finish till the end of the year 2005. I have more than 8 years of experience in automotive engineering in Europe and Canada, but no working experience in US.
Does anyone know if I could apply for EB2 PERM when I graduate and find an employer, even if I don’t have social number and working experience in US?

First you need a future job offer and the employer is willing to sponser you for a green card.

Your job offer - job description only dictate what you ar eligible. Since you are on-line MBA it does not mean EB2,. If it is Automobile Engineering job, you do not even need a master degree, some job require only certificate and work exp and not even Bacehlor's degree.

EB2 or EB3 based on the job offer, not based on your wish, or your MS degree.

This helps a lot. But maybe I should revise my question. My first concern is actually if I could apply for H1B in January for one of the additional 20,000 special cap exemptions for people with U.S. masters' degrees for FY2006 (in case these are not all filled), even if my master is obtained online and I’m currently on H4 visa status. In that case I don’t need to wait till October 2006 to apply for a regular H1B with 65,000 cap.

First of all you no need to mention about on-line degree . On-line is only the mode of delivering the instruction. (Class room/ Correspondence-distance learning/on-line etc). The point is whether you are getting your degree from an US accridted instituition (Recognized by US Education Agency).

Hi Great Guru,

I emphasize that degree is online and I have H4 only because it means that I don’t have a Social Security Number. Does that have to do anything with applying for H1B master degree 20,000 cap? Or I can apply even without SSN?
By the way, University I’m getting the master is accredited, there is no problem with that.

SSN is nothing to do with applying H1. You need Masters degree from US university to qualify for 20,000 quota.

So you qulaify, once you have a US degree.(No need to emphasize medium/mode of instruction from university, degree certificate does not say -it is online or off line)
