EB2 or EB3

Hi,

In prevailing request form (Skill level 2) for Sr. Eng - requirmens says

"Masters degree in Eng (will also accept BS+5 yrs or prog. resp. exp)"

and in paper/online recruiment adv it says

"Must have Master’s degree in Engineering field, or Bachelor’s degree in Engineering and five years of programming experience"

what do you suggest to go for EB2 vs EB3? If EB2, do you see high approval chances?

I was little concern about "bachelor’s degree in Engineering and five years of programming experience". Since it really doesnt say progressive experience in nature. Also what are the chances of any audit on business justification for masters necessity for Skill level 2? SVP < 8. I dont know if its good thing but there is "Other special requirments" in Prevailing wage.

Any comments? I think I should stope to worry about :)

Not necessarily EB-2. What do the requirements in the 9089 say? If they include "Bachelor's degree in XYZ and five years progressive, post-baccalaureate experience in ABC," then it's an EB-2 case. If not, EB-2 would have to be argued for at the I-140 stage.

Also make sure your reference letters clearly indicate that your experience was progressive and post-baccalaureate.

If my PERM is filed based on MS+0 then is there an issue for EB2 because of this BS+5 in programming statement. Please advice. My company attorney says its EB2 but I am in doubt. I have MS in Eng from US.

9089 is not yet filed, its in recruitment phase.

If there's a Master's requirement and you have a US Master's, then it should be good to go for EB-2, though I wonder why they even mention BS+5 as an alternative.

A MS+0 is a bit risky. I hope there are a few special requirements upon which the employer could disqualify applicants.

Thanks Daniela. There is other special requirments like specific software/systems/OS and knowledge of special technilogies etc..
The reason for BS+5 is to make sure the requirmens is not just matched for my skills so to avoide any audits or rfe.. Its sponsoried from staffing firms..what do you see the outcomes? I am getting few other offers in good multinational companies (ready for EB3) and cannot decide whats best?
