Eb2 or Eb3 for MS Computer Science with BS civil

:confused: hello Great Guru,
I am a MS in Computer Science with BS in civil engineering, 3 years Experience. I have been working with the current firm for 2 years as a (N/W and Computer system admin as well as a civil engineer) and want to know if I can file for EB2 and use Database admin as a job title .The compay is ready to do whatever it takes to avertise the position needed by me for EB2 . My company is a civil Engineering company with 50+ employees and mine will be the first GC they will be processing as a IT person. So far they have only done Civil engineers Green cards.
My concerns are
1. Eb2 or Eb3 ?
2. Will my current salary matter(48K per year in Texas) The company is ready to submit an official doc saying that salary will go up?
3. Can I use my cross disciplinary education( MS in Computer science and BS in Civil) to my advantage saying that the firm needs an Computer science person with knowledge of civil engineering?
4. If Eb3 then will it be considerably slower then Eb2?

I am very confused and will really appreciate your input. I have had consultation with one lawer who says that Eb3 is a safe bet. Please help
In terms of documents needed from the company , I have full support from them.

YES. It should be above 55K for Austin County
But you should go as "System Manager" .Post your County exactly. MS with1 or 2 yrs exp

It will not work that way.

My county is Harris county. So as per your recommendation, I will shoot for System Manager. So if my salary as i stated now is 48 K , does it have to be increased right away or later is fine, in order to fit into Eb2 catagory?
Also as my company has never done a Green card for IT person before, will it matter?
P.S: I have never seen such a a quick response from lawers before, even when its paid for. You are awesome!!!

Only later stage the salary should match

If your employer agree to pay level 2 salary after GC approved that is OK.

Just out of curiosity what happens if an employer agrees to pay level 2 wage and does not after the GC comes through? Will it haunt me or him or anyone for that matter? will my green card be revoked? :eek:

2) One year Diploma in computers
3) 8 1/2 years of experience in computers
4) salary drawing 68K in CA
5) Education evaluations says, Equivalent of Bachelors in computer information systems

Do you think, in the above scenario what are the chances for PERM approval?

Yes, if your job requires BS with 5 yrs exp. For CA the average level of salary for EB2 works out to about 75 K +
