EB2-NIW and EB1 People

Based on my reading on this forum and Rupnet, I conclude that EB1 and EB2-NIW people are waiting much longer time than EB3 guys for their I-485 approvals or RFEs. Am I right? Any input?
 
It's probably at the I-140 level since there is a lot more to consider at the I-140 stage for a NIW or EB-1 than for an EB-3.

I just got my NIW approved. Mine and my wife's (dependent) I485 pending since all filed concurrenly. While my wife's H4 was pending sometime ago, she applied unemployment benefit, and got approved quickly. She was laid off at that time, but she did not have EAD card then.

My question is: will this hurt our I485, or just mine, or hers???
When we knew that we were not qualified to claim unemployment benefit, we stopped immediately. We really did not know having EAD is one of requirements to do that. Many people said that was simply an issurance, is this right?

is this public assistance, or public charge? What is the best we can do now?
