EB2 + I-140 premium process questions

Hi there,

My spouse and I are about to start the permanent residency process... I would appreciate it if someone can give me some insights about waiting times and other things.. Here's my situation:

We are from Europe, she is PhD and has H1B and I have H4, currently doing MS. She'll apply through the university as EB2 (teaching) for permanent residency in some weeks. I understand we can pay the $1000 premium and get the I-140 in a couple of weeks.

But then what? I think she (the univ. rather) has to file the ETA-9089. But when the I-485 comes into the picture? And how long it should take for me to be able to start working as permanent resident (myself I need sponsor to get H1B as soon as I finish MS -- in 5 months)..

Unless she is eligible for EB1, she'll have to first apply for labor then I-140. If the priority dates are current for your country you can immidiately apply for 485 and get your EAD in a couple of months.
 
I see... so I guess the labor part is the longest, right? I saw from other posts that it may take a couple of months.. (like you said).. after that, she should apply for the I-140 which shouldn't take more than two weeks and then, after her I-140 has been approved, I should apply for my 485 which is going to take another 2 months (the univ. advises against doing the concurrent filling). Does that mean the process may take around 5 months? Am i correct?

So, let me summarize what I understood are the different stages in the process:

- First, Her stuff:
Labor (ETA 9089?)= 2 months
After labor received, I-140 = 2 weeks

- Then, My stuff, after she received I-140:
I-485 = 2 months?
