Eb2/eb1

Hi all,

My I-140 application (PD 09/2006) under EB2 is already approved. Due to retorgression earlier this year, I filed another application under EB1 OR category. This was concurrent filing for I-140 and I-1485. EB1 is typically taking 13 months these days. I saw in Aug bulleting that dates for Eb2 have bumped 2 yrs to June 2006. Looks like my EB2 may become current before EB1 comes for adjudication. How can I change my current I-485 application to already approved EB2 I-140 incase that becomes current within next 2-3 months?

Your EB2 case may become current in coming months but it's finally the numbers game. All depends on how many candidates are waiting ahead of you (as per Priority Date) and how many visa numbers are available. Please note that currently May 2004 EB2 filers are getting approvals.

I would still rely on the EB1 case in your situation.

In order to attach the approved I-140 to the I-485 you need to interfile. I don't know the process (perhaps an immigration attorney is required here).

I think it will be April 1st 2004 or before candidates are getting approved as till July end only those applicants cases are being picked. If May 2004 applicant is approved then it is sheer luck.
