EB2: Can Master + 2 yrs equivalent to BS + 5 yrs

And I desperately need your help on this.
Here is my case:
I am working at a school, I have a MS degree and 2 year's post-degree working experience. However, the position with I am going to apply for Perm does not require MS degree, So in order to qualify for the EB2, my employer came up a requirement with BS + 5 years experience or Master + 2 yrs.
But, the school laywer told us that the Department of Labor will not consider an educational requirement of a Bachelor's degree and five years
of experience to be equivalent to the requirement of a Master's degree and
2 years of experience.
Is this true? I couldn't find any formal documents that talks bout the equivelent between degree and working experience.
I am wondering if someone could give me info or your thoughts. Your help is highly appreciated!!

I think Bachelor + 5 years = MS + 0 years of experience. So in your case, EB2 filing should be possible. However, I think not only the educational quals but the salary being offered also matters.

This is only my opinion. I am sure that you will find answers else where in this forum. I am sure similar questions have been posted and answered by knowledgable folks on this forum.

Thank you very much! For my case, salary is not concern for EB2 filing. I just need prove "MS = Bachelor + 3 years" or like you mentioned "Bachelor + 5 years = MS +0". Do you know any official document or something eles can support this? Thanks again for your response.

Yes it is true.

MS+2 = SVP Level 8.
BS+5 is also SVP Level 8.

According to DOL, both MS+2 and BS+5 are "substantially equivalent" since both fall in SVP Level 8.
