Did you port old priority date when you filed new i140.
Did you use old i485 or filed new i485

Could you please let me know what all the documents to send when filing I140.. appriciate your help. Did you have to send any cover letter mentioning portability.

I had to attach my previous approved 140 along with other documents and a cover letter which says "Please use priority date of sept 9, 2002 Employees I 485 is pending (A97-***-***)" in the subject.

I'm in the same situation like you. I have my pending I-485 filed in Feb'06 with I140-EB3 from my former employer. Now I'm with different company and got my I-140-EB2(PD 07/2003) in Nov'2006 with slightly different job description.
I need some help to interfile my new I140 to pending I-485. I do not want to file AC21, but I would like to interfile my new I140 without refiling I-485.

When did you do interfiling ? Did you get confirmation from USCIS that they accepted the new I140??

What documents did you send ? Did you make references to Pearson Memo??

Please help.

I am not sure exactly what documents/references my lawyer sent, but she did ask for my 485 receipt.

When you say ported the old PD to the new one, when you filed the second 140 and 485 concurrently did you attach the 1st 140 approval copy and that is how the old PD got ported to the new one?

In my case I have a previously approved 140 with 2000 PD and when I filed my case with 2004 PD concurrently this year I attached the previous 140 approval and based on that I cud apply concurrently. I received my EAD's etc
but when my 2nd 140 got approved in Aug 2006 it had the 2004 PD instead of 2000 PD, now the lawyer has sent a letter to correct this, it's close to 4 months and did not hear from the USCIS yet.

I was wondering sh the 1st PD actually be the one that is printed on the 2nd approval? Please can you tell me was this the case with you. Appreciate your apply

Yes, I had to attach a copy of my previous I140 approval when filing for the new I140

Since I had attached my old I140 approval, my new I140 approval came with my old PD. I hope I am making sense.
