EB2/140 Education eqivalency

My approved LC states M.S or equivalent degree with major filed of Study as Comp science,eng, maths or Equivalent and M.S may be substituated with Bachelors with 5 years Progressive exp after Bachelors.
I do not have an M.S but have an MBA and a Bachelors of Commerce Degree from India , which makes my education 12+3+2 and I had 7 years of Exp prior to my current employer, which was all attained after MBA.While I understand that the LC states Bachelors degree with 5 years ( Which I have) , the problem point is, my LC states major filed of study with Comp Science,Eng ,Maths etc for M.S ( Which ofcourse can be substituted with B.S + 5 years Experience), which I do not have...!( Major filed of study of Comp science,MAths,Eng etc) and I am not sure if my Bachelors in Commerce and MBA will equal a Bachelors in Comp Science or related.( It equals a B.S in Business of education equivalency done)
Would appreciate if somebody can post details, who might have gone thru successfully with similar kind of Education/Work exp past. Also, would appreciate the opinion of other forum members.
I am wondering if this is going to be a major problem point for my 140 approval.
 
This is just my personal opinion but an MBA with a bachelors degree in commerce is NOT equivalent to an MS in CS or maths or engineering.
You can have your credentials evaluated and see what it comes up with.
 
NKM, I understand that my education is not equivalent to M.S computers or Maths or so. The point is I am wondering if my 140 has any chances of approval for the fact that LC mentions M.S in a Specific field which can ofcourse be substituted by B.S+5 Years of Experience. What I am looking at, is that would BCIS be looking into the fact that I need B.S ( Which I have as an equivalency ) in the specific filed of study( Which I do not have). I mean, I have B.S + 5 years of Exp but do not have the education in specific field of study as the L.C mentions M.S ( Specific Filed) or B.S + 5 Yeras of experince.
 
The LC very specifically mentions Computer Science, Engg, Maths or eqivalent. If you have worked in the Computer field, work experience of three years may in certain cases be taken as one year's credit towards graduation. Since you have a Bachelor's degree in Commerce, if your work experience of seven years is in a specialised computer field you may ask for an evaluation from a respectable agency to certify the eqivalence.
The INS would accept such an evaluation.
 
EB3/ I-140 Unrelated Degree

Iam in a similare situation and would appreciate any thoughts please? - Infact Do you thnik i can ever get qualify with the stupid education i have ???#$#$


I have been issued an RFE regarding my educational Qualifications. Iam not confident that the RFE can be convinced, since i have an unrelated degree (Architecture from a Regional Engineering Colege.- India), and a PGDip. in Computer Applications along with TWO Oracle Certifications (OCP) and a few other testing achievements. The LC says ("Bachelors in Computer science or engineering or Equiv.").
Educational evaluations have all been submitted along with the original set.

The RFE asks to provide evidence that I have a Bachelors degree in Engineering or Computer Science. (and "Equivalency" will not be accepted .- God knows why??)

Can any one please share their thought processes that could help me build my response for the RFE??

Will give you an example, a case of Approved LC and I-140 in EB2.
In ETA750A (LC form) it was asked in column# 14
College Degree required( specify):
** Masters Degree
In column # 15 OR bachelor degree equivalent plus 5 years progressive exp
Major Field of Study:
* Computer Sciences
in column #15 OR engineering Or Mathematics or Physical Science
EXP Calumn 2 years
The person has Masters degree in Chemistry and Bachelor of Education ( B,Ed) and O level certificate in computer from Government of India, one more certificate in computer science from Government body and completed only 2 semesters of MCA ( IGNO) had MCA mark sheets and more than 10 years experience in IT( India , Bombay) before LC was applied

His education Evaluation done in US says:
Education Equivalent in the United States
BACHELOR OF SCIENCE DEGREE IN COMPUTER SCIENCE
MASTER OF SCIENCE DEGREE IN CHEMISTRY

He had all his past exp letters on past employers letter heads with job duties, job title and with the words Progressive Experience.

LC was approved and I-140 also approved in EB2, no RFE

It's really, really, extremely, very difficult to evaluate this type of thing over the internet accurately without reviewing all the documents and probably getting an expert opinion (or two) to back it up. It's certainly possible in some cases and it just as certainly is impossible in others. It can be done, sometimes.

I'm planning to go for labour subsitution and trying to understand exactly the way BCIS interprets education qualification mentioned in LC.

If the LC mentions education qualification as
BS in computer science or engineering, should the employee
MUST have

1. BS in computer science (or) BS in computer engineering

2. BS in computer science (or ) BS with any engineering like
BS in mechanical engineering, BS in civil engineering.

which one of the above is correct. 1 or 2 ?

In some cases LC have education qualification mentioned
as BS in computer science or engineering or equivalent. How this
"equivalent" is interpreted by BCIS.
