Hello Everybody,
I am new to this forum and I am in the process of applying for my I-140 EB1-EA. I would really appreciate if you can let me know if my credentials are good enough for EB1A. I will be applying to TSC.

1) I completed my Ph.D in Pharmaceutical Sciences from one of the top 10 schools in U.S in January 2010 and started working as a scientific reviewer (staff fellow) for U.S. Federal agency, FDA (Food and Drug Administration)

2) I review drug applications submitted by pharmaceutical companies through out the world and make a decision whether to approve or reject the drug product. Only the drugs approved by FDA can be marketed. To just name a few, these drugs include anti-cancer, cardiovascular, anti-HIV

3) Currently Iam on my H-1B sponsored by FDA.

4) I have 10 publications, out of which I am the first author for 6 of them.

5) I have around 17 citations. One of my paper which was published in 2010 in a top journal in our field was one of the most viewed paper.

6) I have more than 15 abstracts presented at various conferences.

7) I am a reviewer for several journals but have reviewed 2 papers so far.

8) I am an International Scientific Advisory Board Member for one of the Journal

9) Editor-in-Chief for a journal

10) Serve on the editorial board for a journal

11) One invited talk at Dr.Reddy's Labs in India (which is the second largest pharmaceutical company in India)

12) Have few awards at univeristy level and a best poster award at a national meeting.

All your help is greatly appreciated

I have a suggestion. Since you works for a Fed agency why don't you try EB1-OR. Since you are in FDA it must be a sure shot.

You may also try EB2-niw, if your EB1 petitions get denied then you may atleast have that. Your current employment should make it like peanuts.

Since I work for a federal agency, they are not willing to sponsor for permanent residency. Even I thought of applying eb2 niw as a back up, but since I am from a retrogressed country do you think that would be helpful.

If you get NIW approved you can renew your h-1 indefinitely (I think). But you'd have difficulties travelling outside US.

That means you'll have some status. But in the time period between the petition and AOS, you'll not have same privilages as a PR (like changing jobs at wil ,go to school, buying a house ). Lot of people posting here have undergone the same long agony. They can give you advice.

I am telling you to apply by niw because something is better than nothing, right.

Although you have excellent resume, but it falls short when you have to prove to meet at least three of those 10 criteria. You definitely meet two and that's why above fellow was suggesting EB1-OR. I suggest you get 20 more reviews to make sure that your case is well established (and well-prepared of course) and you should be all set.

I am will be graduating with a PhD from one of the top 5 schools in US and will be doing a post doc starting August.
My F-1 visa is expiring (I will be on OPT) and so I was thinking of applying for a GC under EB1 so that I can travel to India and conferences outside US.
These are my details:

- PhD in Computer Science (USA)
- Reviewer for 1 journal and 2 conferences
- 7 journal papers (5 first author)
- 10 conference papers (8 first author)
- 3 invited book chapters
- over 120 citations
- 4 poster presentations
- 5 international awards (best thesis, best papers, phd fellowship ....)
- 3 professional memberships

Do you think I have a strong case?

I have a few questions:
1. Typically, how long will it be before I have the GC in hand?
2. Which center should I be filing too?
3. Can I self-apply using a DIY kit?
4. If will be on OPT for the post doc, will it reduce my chances for a green card?

If you get NIW approved you can renew your h-1 indefinitely,But you'd have difficulties travelling outside US.EA and NIW are complex situations and only a legal professional can evaluate the case properly to give proper direction. It consult a good one.
