EB1 or not?

My priority date for EB2 is 4/23/2003 and the date has been stuck on January 8,2003 for a year. :mad:

Should I apply for EB1 at this point or keep waiting like the ever optimistic one? :confused: The credentials are good and lawyer has given me very high chance of approval.

Please advise.
 
My priority date for my NIW I-140 is 7/25/2005 and the visa priority date for India is stuck for long time on Jan 2003. I remember last time it moved only 7 days. I have no hope of its movin further. If you carefully gather information aorund net then you will notice the fact that priority date had actually been moving extraordinarily faSt due to VISA tickling effect. They were using the unused viasas for other categorIES to feed NIW, but due to consistent high demand of visas duing last few years those viasas too have been exhausated, and that why we now see retrogression for countries which had been using lot of visas like India or China. So from now onwards there is NO HOPE of the priority dates moving any further. Some even predict they may retrogress further.

I think this article on this issue will help you understand this issue further and act accordingly. I have no hope since my priority date for my I-140 NIW is 7/25/2007 and there is almost 2.5 years gap between the visa dates for India so if I stay in NIW I can expect to get my GC sometime in 2015 or later if date move at current pace. I cant wait that long since staying in USA is not that attractive now days with rising inflation, decreasing job security and economy falling apart. So earlier the better. I applied for EB-1A and got approved, now waiting for them to process my I-485 based on my approved EB-1A. Lets see what happens, since visas are still current in thie category for INdia.

How important is the attorney in this process: my own lawyer vs a prominent EB1 lawyer from NY- have a difference of $5000 in price- any thoughts?

Either do it yourself or get a very good attorney.
Don't give money to someone who will just type the I-140 form.
 
Do not go for attorneys who are over priced. There are some very good attorneys who charge far less. And some charge a part of the fee only on approval. If you need a few names let me know.

There was a recent discussion about finding a good lawyer in this forum. You may want to find that one. Some really nice instructions. Search for posts by ajasha. There were others too... niwnow? niwengineer? Dont recall.

NIW2, could you send me the names of a few good attorney who have good experience and success rates.

The lawyer I have talked to charges 8000 regardless of approval or not, I wonder if I can negotiate part of it to be given only if there is approval.
 
Attorney or self petition

India: As suggested in the post check the prior discussions on attorneys. I have also made a few comments on this subject.

I think a few folks who have good cases (publication records, citations etc) have filed self petitions and have got approved. But there are many (like me) who had limited number of publications, time and writing skills to do a self petition. In my case it saved me a lot of time and headache and I had an efficient attorney at reasonable fee to file my case for me.

But 8000.00 is way over the top and I am sure he/she is going to ask you to do most of the work. My attorney charged me 3500.00 in two payments with half the payment only on approval. He said the reason was that he was sure that he will get the approval fee. (I was glad to give him that) And he drafted all my letters etc... I heard from my friends that there also couple of other attorneys in Texas who do a good job. Check my previous postings for names of attorneys..and if you are unable to find it, let me know. I will go back and dig it out for you.
