EB1-OR,I140 Denied

Hi all,


please, please, please someone help me, today is my bad day when I got email, my I140 got denied. I am working as research scientist on permanant position in Univeristy.


PD 04/25/2007,RFE 04/2008,respond to RFE on 05/20/2008,Denied on 06/11/2008

What should be my next steps ? Please help me, I am totally nervous and frustrate.

Could you post crediential, any RFE.. so that other can look into that.

Yes there was a RFE in April this year for International reconisation which my attorney sent to INS and also other document,my credential is

Phd- India
Post Doc 2 year in Japan
Post Doc 2 in US and now in permanant position-research scientist
publication around 8
citation is around 40


I am waiting for denial letter and available options. Please suggest me about MTR or re-apply which one is best ?

What about awards?? Which center processed your application? How did you respond to RFE and what were the further evidences provided by you?
Answers to these questions might help others in suggesting you the next step...

Attorney provided my Japan JSPS fellowship as award. I don't have any other award as such....

My attorney considered JSPS selection procedure as award and also send my membership letter plus 10 international professor's recommendations.
 
I think your attorney handled the RFE pretty well!! Did you also file under EB2 category?
I'm in the same situation but I also filed EB2 along with EB1b. Decision on my EB1 140 is pending.
We have some experienced people in this forum who could give you reasonable suggestions......don't worry dear......this is not the end of the World for you!!

My attorney filed under EB1-OR. I didn't file any other application. As I mentioned I am research scientist on full time position.thanks for your support & help.


I know this is amazing forum and we have so many knowledgeable person who can suggest me next steps. Please help me guys .
 
could you tell us more such as what RFE was about in more detail? What information they asked etc.?
 
reading from your earlier posts u came here on J2 and changed to H1B.
you were also mentioning about HRR in those.
by any chance you did not get the waiver or did not attach those relevant papers along with your I-140?

JSPS is equivalent to NIH fellowship. so that is still a postdoctoral fellowship that does not constitute an award. If u had claimed that as one of the three criteria then that does not qualify.

reapplying only will be a better chance. I know that may be a very bad suggestion.

post some more details about your case like how many category you claimed and what were the evidences you provided to substantiate your claims, what was your RFE and what was your reply.

the list may seem big but unless few of the details are known it will be difficult to suggest future course of action.

Sorry to hear about the denial and please post the details of the letter when you receive it. What things were they looking for in your RFE? Did they question the permanent nature of the job (as they have for several other OR applicants)?
