I have taken the first few steps to get my app together for EB1-OR. Wondering if folks could comment on my case given the diverse experience.

  • BS, MS (at a Top-5 US school), 5 years experience post-school.
  • Small (70) Company with 3+ PhD's
  • 5 Journal articles - 30+citations, including books, 1 newspaper citation.
  • 15+ Conference presentations
  • A nationally (US) known award
  • Venture funded healthcare product from my work
  • 2 Patent Applications with a second product to be developed around the corner (Press evidence)
  • 6 letters - all from outside the company.
  • Judge for an Achievement award,
  • Invited talk at a conference, [*]Editor of 1 jnl, [*]Reviewer of 2 jnls [*]Invitation to author journal articles
  • No Membership of Associations

thanks in advance

Sorry, but your case seems a bit thin to me. First, I have not actually heard of people without a PhD having been approved under EB1-OR. Your publication record is rather small (just 3 journal articles) and there is too little evidence of having served as the judge of the work of others. Usually they'd want to see some evidence that you refereed a number of research papers and grants. IMHO, you don't have much of a chance of being approved under EB1-OR.

And I decided to follow-up with my lawyer and found out that a PhD is not a must and he is clearly aware of other applicants without a PhD who have managed to get thru via EB1B.

I got my green card via EB1-OR. I don't have PhD - MS in CS and 6+ years experience. Permanent (current) position at an ivy-league which may have made a difference though - since the HR here normally apply for only faculty members. I have around 10+ papers/journals and book chapters. Memberships may be important.

Your cover letter should be strong to make a good case. Good luck!

The eval period allows you to download patches and get support. After the eval period the software will continue to run just fine.
